After the bid opening, the bids will be compared as to quality, thoroughness, and cost by a representative of the Wood County Schools (hereinafter referred to as the "Owner"). The Owner or any of its employees will not be responsible for any unmarked bids opened. There is no pre-bid meeting. Questions shall be submitted to Ashley Brown at ashley.m.brown@k12.wv.us. Questions shall be received date and time to receive an answer. Answers, citing the question asked, will be distributed by email simultaneously to all known prospective bidders. No answers to inquiries will be addressed after the deadline. Questions shall be received by 10:00, May 31st, 2024, to receive an answer. All bids must be accompanied by a Bid Bond, executed by the Bidder and an acceptable Surety, in an amount equal to 5% of the bid. The successful bidder shall submit a Performance and Material Bond within ten (10) calendar days of award notification. Failure to submit a Performance Bond nullifies the Bid. The successful bidder shall ensure that all employees and applicants for employment are not discriminated against because of race, creed, color, sex, or national origin. No bidder may withdraw his bid within thirty (30) days after the bid opening. The Owner reserves the right to conduct such investigation as necessary to determine the responsibility of a bidder, to waive all the informalities in the bidding process to the extent permitted by law, to reject any or all bids, and to make selections from the bids that are solely in the best interest of the Owner. Pursuant to Chapter 21 - Article 11 of the "West Virginia Contractor Licensing Act" all Contractors doing business in West Virginia must be licensed to perform work in the State. The Contractor's WV License number shall be affixed to all submitted construction bids and fully executed and binding construction contracts and agreements. The Owner shall have the right to reject any or all bids and to reject a bid not accompanied by the required bid security or by other data required by the bidding documents or to reject a bid which is in any way incomplete or irregular. The Owner shall have the right to reject a bid based on a bidder's past work practices (with the Owner and/or other firm/government agency). In addition, any judgments or complaints against a bidder shall be cause to reject a bid. The Owner shall be the sole determiner as to bid acceptance or rejection.
