Water System Improvements - New Water Well - Construction of a potable test water well and new permanent potable water well and other related appurtenances at the existing water treatment facility. Each Bidder must deposit with his proposal a Bid Bond or Certified Check in an amount equal to five percent of his bid, payable to the Town of Decatur, Mississippi, as bid security. Bidders shall also submit a current financial statement, if requested, by the Town of Decatur, Mississippi. The successful bidder will be required to furnish a Payment Bond and Performance Bond each in the amount of 100 percent of the contract amount. FE JOB #7353 Contract time shall be 360 consecutive calendar days from the effective date shown in the Notice to Proceed. Awarding public contracts to non-resident Bidders will be on the same basis as the non-resident Bidder's state awards contracts to Mississippi Contractors bidding under similar circumstances. In order to ensure that Mississippi's so-called Golden Rule is followed, state law requires a non-resident bidder to attach to his bid a copy of his resident state's current laws pertaining to such state's treatment of non-resident contractors. The work to be performed may be funded in whole or part by any combination of the following funding sources: o Community Development Block Grant Funds o Drinking Water State Revolving Loan Funds o Mississippi Municipality and County Water Infrastructure Grant Program The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended 12 U.S.C. 1701u (Section 3). CDBG regulations governing the grant require hat, to the greatest extent feasible, opportunities for contracting, subcontracting, training and employment arising in connection with this CDBG project will be extended to Section 3 businesses and Section 3 residents. Minority and women's business enterprises are solicited to bid on this contract as prime contractors and are encouraged to make inquiries regarding potential subcontracting opportunities, equipment, material and/or supply needs. This project is subject to the Build America, Buy America Act (BABAA) requirements under Title IX of the Infrastructure Investment and Jobs Act ("IIJA"), Pub. L. 177-58. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States, as further outlined by the Office of Management and Budget's Memorandum M-22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, April 18, 2022. This contract is funded in whole or in part by funds as is established in the Safe Drinking Water Act's State Revolving Loan Funds (42 U.S.C. 300j-12); therefore, this project must comply with the American Iron and Steel requirements of the Act. Any contract or contracts awarded under this invitation for bids are expected to be funded in whole or in part by anticipated funds from the Drinking Water Systems Improvements Revolving Loan Fund (DWSIRLF) Loan Program from the State of Mississippi. Neither the State of Mississippi, the Local Governments and Rural Water Systems Improvements Board, nor any of their employees is or will be a party to this invitation for bids or any resulting or related contracts. This procurement will be subject to all applicable sections of the Mississippi Code of 1972, Annotated, as they apply to local governments, in accordance with Appendix D of the DWSIRLF Program Regulations.
