The following specifications are provided as a minimal requirement only. The City will consider any product that meets or exceeds the minimum requirements. Bidders shall provide information regarding the proposed product for evaluation by the City. It is understood that the selected Bidder will offer guaranteed firm prices for twelve (12) months (7/1/2024 - 6/30/2025) and all drinking water treatment must have NSF60 approval, if applicable. Orders will be placed on an "as needed, when needed" basis; the City of Flowery Branch does not guarantee any minimum or maximum quantities under this bid. Bidders will be required to have trucks with liftgates and must make delivery to our respective facility accompanied by City staff. The Bidder shall provide the City with monthly invoices upon delivery. The Bidder shall assign a Project Manager who will meet with City staff on a quarterly basis. Polymer (types-1280,1640,7291) All Drinking Water Chemicals must have NSF/ANSI/CAN 60 Certification. This request will result in a twelve (12) month contract, with an option for either party to exit at the end of each fiscal year, or to renew for another year for a total of three years. The City may consider price increases at each renewal period of the Contract, provided such proposed increases are reasonable and acceptable to the City. Contract Effective Date Monday, July 1, 2024 The City will select the bid that, in its sole discretion, is the most responsive and responsible bid to the City. The City reserves the right to award the bid item-by-item or by lump sum. The City reserves the right to issue a secondary and tertiary award. The City reserves the right to make any award without further discussion of the bid submitted; there may be no best and final offer procedure. Therefore, the bid should be initially submitted on the most favorable terms the contractor can offer. The specification may be altered by the City of Flowery Branch based on the contractor's bid and an increase or reduction of services with the manufacturer may be negotiated before award and execution. Should the Owner require additional time to award the Contract, the time may be extended by the mutual agreement between the Owner and the successful Bidder. If an award of Contract has not been made within ninety days of the Bid date or within the extension mutually agreed upon, the Bidder may withdraw the bid without further liability on the part of either party. The City of Flowery Branch reserves the right to reject any or all bids at any time without penalty. Any vendor, who acts as a supplier to another vendor submitting a bid and also submits a bid of their own, will be viewed as participating in Collusive behavior. This behavior displays a pattern or practice of unethical or immoral business practices. Any vendor associated with this practice may be banned from doing business with the City of Flowery Branch for up to three years.
