This RFSQ is not a tender call, rather to prequalify Proponent(s) in a Vendor of Record (VOR) arrangement. This RFSQ does not commit the Hospital in any way to select a Qualified Proponent, or to proceed to negotiations for an Agreement, or to award any Agreement. The Hospital reserves the complete right to at any time reject all Proposals, and to terminate this RFSQ process. This RFSQ is not intended to create, and should not be construed as creating, contractual relations between the Hospital and any Proponent. The term of the VOR arrangement is intended to be in place for a period of up to three (3) years. To become a VOR, proponents must agree to enter into a Form of Agreement with the Hospital for individual projects as tendered (along with all other supplementary conditions and contract requirements). Each project will receive internal approval prior to any work commencing, which will be specified and agreed to for each respective project in the execution of an Association of Consulting Engineering Companies (ACEC) Document 31-ENGINEERING AGREEMENT BETWEEN CLIENT AND ENGINEER with Schedule C - Supplementary Conditions, or other such contract, by both parties. Additional Supplementary Conditions may be negotiated with the selected proponent(s) as required by the specific project magnitude.
