sealed bids will be received by the Township of Nutley for the collection of Solid Waste, Yard Waste and Bulk Waste with disposal at the designated facilities from within the Township of Nutley, Essex County, New Jersey. The Township of Nutley reserves the right to consider the bids for sixty (60) days after the receipt thereof, and further reserves the right to reject any or all bids, either in whole or in part and also to waive minor immaterial informalities and/or make such awards or take action as may be in the best interest of the Township of Nutley, in accordance with applicable law. Bids must be on the bid form prepared by the Township, in the manner designated therein and required by the specifications, must be enclosed in sealed envelopes bearing the name and address of the bidder on the outside and bearing on the outside reference to the particular work bid upon. Said bids shall be addressed to, Township of Nutley, Attention: Eleni Pettas, Municipal Clerk, 1 Kennedy Drive, Nutley, New Jersey 07110. Each bid shall be accompanied by a certified check, cashier's check or bid bond duly executed by the bidder as principal and having as surety thereon a surety company approved by the Township of Nutley in an amount not less than ten percent (10%) of the amount bid but in no case in excess of $20,000.00. Any such bid bond shall be without endorsement or conditions. Bid shall also be accompanied by a certificate letter from a surety company stating that it will provide the bidder with a performance bond. The award of the contract shall be made to the lowest responsible bidder subject to the necessary moneys to do the work being provided by the Township of Nutley in a lawful manner. The contract to be executed by the successful bidder will provide that it shall not become effective until the necessary moneys to do the work have been provided by the Township of Nutley in a lawful manner. The award shall further be subjected to the securing of necessary State, Federal or Local permits governing the work. Bidders are required to submit the additional documents including, but not limited to: a photocopy of bidder's certificate of public convenience and necessity and an approval letter issued in conformance with N.J.S.A. 13:1E-126 et seq., a Questionnaire setting forth experience and qualifications, a Non-collusion affidavit, Business Registration Certificate (due prior to contract award) issued by the New Jersey Division of Revenue in accordance with N.J.S.A. 52:32-44(b), and a Certification regarding investment activities in Iran (due prior to contract award), in accordance with N.J.S.A. 52:32-58. The Contractor is further notified that he/she must comply with N.J.S.A. 52:25-24.2 and submit a Disclosure Statement listing stockholders with his/her bid.
