This is a Notice of Proposed Contract Action under FAR Part 12 Acquisition of Commercial Products and Commercial Services, and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 811310 with a small business size standard of $12,500,000 in average annual receipts. The Government requires procurement of this annual maintenance service on its existing Liebert UPS batteries, and intends to negotiate a sole-source contract for this requirement with Vertiv Corporation 505 N. Cleveland Ave, Westerville, OH 43082. The applicable Liebert part numbers and associated product descriptions are as follows: Item 1 - APM 15 WINTBATT, Tag # 17733330, Model #NRA40CCSAFA30DN, Annual PM Item 2 - APM45-90PERIPH, Tag # 1773331, Model # NRMB0C40RA00V5, Annual PM The Government has determined that other companies' products and services do not meet or cannot be modified to meet the Government's needs due to the following: Maintenance and Troubleshooting Information Vertiv Customer Engineers (CEs) are the only authorized, factory- trained and OEM-supported service providers for Vertiv equipment with access to Vertiv's proprietary service tools and software to ensure optimal equipment performance. Vertiv Uses proprietary software PPvis(TM), Paramset(TM), and WinSVT(TM) CEs apply Vertiv's knowledge base to diagnose, configure and optimize your Vertiv equipment. Vertiv is the only authorized source for critical proprietary firmware updates providing their equipment the latest version of operational firmware to ensure equipment is running at optimal performance and efficiency levels. Vertiv exclusively enables: o Access to OEM engineering support and product enhancements. o Optimized methods of procedure for efficient service supported by proprietary documentation. o Improved MTBR and MTTR. o Root cause forensic analysis. o Continual improvements with tested and certified updates for software and hardware improvements throughout the equipment's lifecycle. Field Change Notice (FCN) o The FCN process for Liebert equipment is managed by PTS and factory personnel and is not available to outside service organizations. o The FCN process allows for engineering improvements to be made to the equipment as soon as an enhancement has been identified. These FCNs enhance the safety and reliability of Liebert power systems. o Safety related FCNs are distributed to the Vertiv customer contact on file. Contract customers are automatically notified and scheduled for installation. o Technical FCN enhancements are only available to Vertiv contract customers. Given the information above, the Government has determined Vertiv to be the sole-source provider for this requirement. This is a notice of proposed contract action and NOT a request for competitive proposals. However, all responsible sources may submit a capability statement or proposal, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 30 July 2024. A Sole Source Justification will be attached to the subsequent Notice of Award in accordance with applicable regulation. The Method of Contractor Selection has not been determined at this Time.
