The initial term of this Contract shall be from July 30, 2024 to June 30, 2027 (Term), unless earlier terminated as provided. The Contractor shall complete the Maintenance Program within the Term of the Contract and shall meet any other established schedules. WORK SCHEDULE: The Project or Work is anticipated to begin in July 2024. This solicitation is for a multiyear commitment. The term of this contract is for a minimum of one (1) year with a total of two (2) additional fiscal year options for renewal, at the City's discretion, to a total of three (3) years. Estimated Quantities: The City of Chino anticipates an estimated annual usage of approximately 62,000 gallons. The City of Chino will not be obligated to purchase any specific quantities and reserves the right to purchase either more or less product, based on seasonal adjustments, at the firm-fixed price quoted. Scope of Services The City of Chino is soliciting bids for Hydrochloric Acid FCC/NSF Grade for water treatment purposes. Please review the attached documents for further information regarding specifications. DESCRIPTION OF WORK: City is requesting Bids from qualified suppliers for Hydrochloric Acid FCC/NSF Grade (Muriatic Acid 200 Baume). Goods to be provided are as further described in Section II - Technical Provisions. The Bidder is expected to provide all goods that will fulfill or exceed the requirements and conditions as set forth in this IFB. The Contract will be a firm-fixed price contract between the City and Contractor for the abovementioned product. Hydrochloric acid delivery shall be coordinated and scheduled by the City Water Systems Plant Operator. Product Requirements. Liquidated Damages. The parties to this Contract agree that, in the event that the goods and services provided under this Contract are not delivered or completed on time, the City will sustain damage and that it will be impracticable and extremely difficult to ascertain the actual damages that the City will sustain. In the event that Contractor fails to complete any of the services or deliver any of the goods required by this Contract on or before the completion or delivery date provided herein, or within the period of any authorized extension, Contractor shall pay the following amounts to the City as liquidated damages: (a) 20% of the price of the goods or services for any delay of up to 2 business days. (b) 50% of the price of the goods or services for any delay of 3 to 5 business days. (c) 100% of the price of the goods or services for any delay of more than 5 business days. The City reserves the right to reject any or all Bids, to waive any irregularity, and award contracts in the best interest of the City. Bidder specifically waives the right to request a Change Order, equitable adjustment, or to request additional time, or to seek recovery in quantum meruit in conjunction with any such issue. Bidder further waives the right to assert arguments of estoppel or implied or express warranty of design with regard to any such issue. The successful bidder is required to furnish a Bid Bond in the amount of 10% of the contract amount, Labor and Materials Bond in an amount of 100% of the contract amount, Faithful Performance Bond in an amount equal to 100% of the contract amount, and a Warranty Bond in the amount of 10% of the contract amount; the bonds to be secured by a surety company or surety companies satisfactory to the City Council of the City of Chino Bid Bond 10.00% Payment Bond 100.00% Performance Bond 100.00% If the City determines that the protest is frivolous, the party originating the protest may be determined irresponsible and that party may be determined to be ineligible for future contract awards.
