All bids must be made on the official Bid Form or an exact copy by reproduction thereof and enclosed in a sealed envelope. No Bidder may withdraw his bid within sixty (60) calendar days after the actual date of the opening thereof. Each bid must be accompanied by Bid Security in the form of a certified check, bank check, or bid bond in the amount of five percent (5%) of the total amount of the base bid. The successful bidder will be required to furnish a Performance Bond and a Payment Bond in the statutory form of public bonds required by Section 137 of the State Finance Law, each for one hundred percent (100%) of the amount of the Contract. This is a public works project and state prevailing wages as determined by the New York State Department of Labor must be paid. Provisions for prevailing wages are set forth in this Project Manual. The Town affirmatively states that in regard to any contract entered into pursuant to these instructions, without regard to race, color, sex, religion, age, national origin, disability, sexual preference or Vietnam Era veteran status, disadvantaged and minority or women-owned business enterprises will be afforded equal opportunity to submit bids in response hereto.
