The Fund is seeking Statements of Qualifications (SOQs) from Consultants to provide project labor agreement services via Master Term Agreements. A project labor agreement (PLA) is a pre-hire collective bargaining between a contractor and a bona fide building and construction trade labor organization establishing the labor organization as the collective bargaining representative for all persons who will perform work on a public work project, and which provides that only contractors and subcontractors who sign a pre-negotiated agreement with the labor organization can perform project work. (New York State Labor Law Section 222). Contract term: Five Years. Any questions regarding this procurement should be emailed to: SUCF.ConsultantProcurement@suny.edu. Sections 370 and 376 of the Education Law require Project Labor Agreements (PLAs), pursuant to a feasibility study consistent with the process established in State Labor Law (Section 222), for all large-scale construction projects. Large-scale construction projects are defined as projects with an estimated construction cost of $10 million or more. A PLA on a construction contract or contracts for such large-scale construction projects will be required if a study shows that the PLA would: Result in the best work at the lowest possible price; Prevent favoritism, fraud and corruption; Reduce project delays; Potentially generate cost savings; or Prevent labor unrest. To analyze a project and any potential economic savings, the Fund will require a properly documented study showing the effect of the use of a PLA on the Fund's objective of completing the project at the lowest reasonable cost. The Fund will weigh the analysis with attention on NET projected savings. While the PLA feasibility studies should largely focus on the NET savings, PLAs may also be used to achieve other objectives. These objectives may include such goals as: improved employment opportunities for minorities, women and economically disadvantaged individuals; prevention of potential labor unrest and the resulting schedule delays; increased apprenticeship levels for minorities; and ensuring a reliable source of skilled and experienced union and non-union labor. These purposes, however, shall not be considered as primary objectives in evaluating the need for a PLA. If the Fund pursues a PLA, it will then require negotiation services. The study consultant may lead those negotiations or may participate in a supportive role. Submissions should emphasize the Consultants significant past experience in providing PLA feasibility study and PLA negotiation services in New York. Diverse experience, with projects in a variety of the State's regional building trades councils. Experience conducting and negotiating studies on behalf of public clients is preferred. Short-listed consultants will be required to submit a maximum hourly bill rate, that, if awarded a Term Agreement, will not be exceeded for any assignment for the life of the term contract. The Fund anticipates issuing three (3) Statewide Term Agreements. Each Agreement will have a $3 million maximum total fee over the life of a five-year contract. Interested firms should provide a Statement of Qualifications that is clear, concise, and formatted as noted below. The SOQ should describe the respondent's specific understanding of and its ability to meet the requirements of the Term Agreements being procured.
