Site work and paving for a civil project in Minneapolis, Minnesota. Conceptual plans call for site work for a road / highway; for paving for a road / highway; and water / sewer project.
This notice advises City of Minneapolis contractors of their commitments under Minneapolis Code of Ordinances section 139.50. All contractors must comply with all provisions of Minneapolis Code of Ordinances Title 7 and with all rules and regulations issued by the Minneapolis Department of Civil Rights ("MDCR") director. Contractors will be subject to a pre-award compliance review. Failure to cooperate may result in denial of contract award. The contractor will not discriminate against any employee or applicant for employment because of race, color, creed, religion, ancestry, national origin, sex, sexual orientation, gender identity, disability, age (over the age of 18), marital status, familial status, or status with regard to a public assistance program. The contractor will take affirmative action to ensure that all employment practices are free of such discrimination. Such employment practices include but are not limited to the following: Hiring, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff, termination, rates of pay or other forms of compensation, and selection for training, including apprenticeship. The City of Minneapolis is soliciting proposals for engineering and design services for the 35th Avenue North Flood Mitigation Project. This includes preparation of street geometry layouts as necessary, construction plans for bidding, and construction engineering support. The contractor will, in all solicitations or advertisements for employees placed by or on behalf of the contractor, state that it is an equal opportunity or affirmative action employer. The contractor must have an Affirmative Action Plan approved by MDCR before it may enter into a contract over $100,000 with the City. When applicable, the contractor must comply with the SUBP program, including, but not limited to, making a good faith effort to meet the Minority-Owned Business Enterprises and Women-Owned Business Enterprises goals established on City construction and development projects. The contractor should make a good faith effort to meet the City's aspirational construction workforce goals of 20% female participation and 32% minority participation. When applicable, the contractor must comply with prevailing wage laws on City construction and development projects. For contracts greater than or equal to $50,000, contractors and subcontractors may be required to submit Certified Payroll Reports, via any software systems specified by MDCR. When applicable, the contractor must comply with Section 3 of the Housing and Urban Development Act of 1968, as amended. Contractors must incorporate the Section 3 Clause into all subcontracts and to the greatest extent feasible, ensure that employment and other economic activities be directed to low income persons. The contractor must provide this notice to its trade and labor union or representative of workers and must post the notice in conspicuous places available to employees and applicants for employment. The project corridor is Washburn Avenue N, between 35th Avenue N and 36th Avenue N; 35th Avenue N, between Washburn Avenue N and Russell Avenue N; Russell Avenue N, between 34th Avenue N and 35th Avenue N; and 34th Avenue N, between Washburn Avenue N and Queen Avenue N. This area has been identified as a significant flood problem and has been prioritized for improvements in the City's flood mitigation budget. This project's primary focus is improving storm sewer infrastructure to reduce street and residential structure flooding, but will also include street cross section, pavement, stormwater management, and greenspace improvements. The City of Minneapolis makes this Request for Proposals (hereinafter referred to as the RFP) to select a qualified Consulting Firm (hereinafter referred to as the Consultant) to provide 35th Avenue North Flood Mitigation project engineering and design services (hereinafter called the Project). The Project is generally described in the "Scope of Services" (Attachment B), contained within this RFP, including descriptions of roles, responsibilities and relationship of the Consultant, City, and other parties involved in the Project. ) Reporting may be required in accordance with any of the above-mentioned programs via any software systems specified by MDCR. Consultant may visit the Project site in reference to the services to be provided; but is prohibited from interviewing City staff or other visitors in any effort to obtain information relating to this RFP. All requests for clarification should be submitted in writing as outlined in this RFP. Failure to follow this prohibition could result in the rejection of the proposal. The City does not promise to accept the lowest cost proposal and specifically reserves the right to reject any or all proposals, to waive any formal proposal requirements, to investigate the qualifications and experience of any Contractor, to reject any provisions in any proposal, to obtain new proposals, to negotiate the requested services and contract terms with any Contractor, or to proceed to do the work otherwise. Incomplete proposals and proposals not sufficiently detailed or not in acceptable form may be returned for completion or may be rejected by the City Responses to Questions posted by 4:00 PM on July 30, 2024 The Consultant's primary interface with the City will be with the Contract Manager who will act as the City's designated representative for the Project. Consultant must comply with the Small & Underutilized Business Program (SUBP), as detailed in Chapter 423 of the Minneapolis Code of Ordinances. The SUBP Ordinance applies to any contract for the provision of goods and services in excess of one hundred and seventy-five thousand dollars ($175,000). SUBP goals are set on contracts based on project scope, subcontracting opportunities, and availability of qualified MBEs/WBEs. There are no specific SUBP goals on this RFP. However, if there are subcontracting opportunities later identified, Consultant shall inform the Contract Manager to obtain authorization as stated under the section titled "Subcontracting" in the Terms and Conditions. Consultant shall take action to afford MBEs and WBEs full and fair opportunities to compete on this contract and resulting subcontracts.
