The Nebraska Game and Parks Commission reserve the right to accept or reject any or all Bids and to waive any or all informalities or irregularities The Independent Contractor is responsible for compliance with all laws, ordinances, orders, and rules and regulations but not limited to, obtaining any necessary permits, licenses, and inspections. The contracting agency shall upon its own action or upon written request of an authorized representative of the Department of Labor, withhold or cause to be withheld from the contractor under this contract, or any other Federal contract with the same prime contractor, or any other federally assisted contract subject to Davis-Bacon prevailing wage requirements, which is held by the same prime contractor, so much of the accrued payments or advances as may be considered necessary to pay laborers and mechanics In accordance with Neb. Rev. Stat. ß 72-803 (4), bidder's proposal shall be submitted on a form supplied with the Bidding Documents and must be accompanied by a certified check, cashier's check, or Bid Bond in the amount of 5% of the total Bid, made payable to the Nebraska Game and Parks Commission as Bid security The Bidder shall furnish the required 100% Performance and 100% Labor and Material Payment Bonds to the Commission not later than the date of execution of the Contract The left bank of the Elkhorn River will be stabilized to repair damage caused by the 2019 flood. Approximately 980 cubic yards (CY) of type “B” riprap will be placed along 295-feet of the bank. The riprap will be placed on filter fabric, and all riprap placed above the ordinary high watermark (OHWM) will be covered with 6-inches of topsoil and seeded. Total permanent impacts from the stabilization activities include 0.028-acre of PSSA riverine channel wetlands and 0.078-acres (295 linear feet) of channel below the OHWM.
