Gilcrease Museum Parking Lot Project. A Cashier's Check, a Certified Check, or a Bidder's Bond, in the amount of five percent (5%) of the amount of the total proposed bid, shall accompany the sealed proposal of each Bidder and shall be retained by the OWNER as liquidated damages in the event the successful Bidder fails, neglects, or refuses to enter into the CONTRACT for the construction of said work, or fails to furnish the required bonds within ten (10) working days after the date the award is made. Bids will not be considered unless accompanied by said Cashier's Check, Certified Check or Bidder's Bond in the required amount and made payable to the Osage Nation. The required performance, statutory and maintenance bonds to be provided shall be in the amount of one-hundred percent (100%) of the contract price. Surety companies executing the bid bonds and the performance, statutory and maintenance bonds to be provided by the successful low Bidder as part of executing the contract for the project, must appear on the most current list of the United State's Treasury Department and be authorized to transact business in the State where the project is located. Bidders agree to commence work within ten (10) calendar days after the date of a Notice to Proceed work order has been issued by the construction manager, and to complete the same as follows: _120__ calendar days. The OWNER reserves the right to reject any and all bids received for this project. Bids will be publicly opened and examined for accuracy and completeness by the Procurement Officer of the Osage Nation. The results will be published to all prospective bidders who submitted a bid. The Owner reserves the right to waive irregularities and to reject any and/or all Bids and/or portions thereof.
