No proposal shall be considered or accepted by the Town Council unless at the time of its filing the same shall be accompanied by a deposit with the Town of Rolesville of a certified check on some bank or trust company insured by the Federal Deposit Insurance Corporation, in an amount equal to not less than five per cent (5%) of the proposal. In lieu of making the deposit as above provided, such bidder may file a bid bond executed by a corporate surety licensed under the laws of North Carolina to execute such bonds; conditioned that the surety will upon demand forthwith make payment to the Town of Rolesville upon said bond if the bidder fails to execute the contract in accordance with the bid bond. This deposit shall be retained if the successful bidder fails to execute the contract within ten days after award or fails to give satisfactory surety as required herein. This contract is for the construction of approximately 270 LF of greenway; to be inclusive of 30 TN of asphalt, 110 TN of Aggregate Base Course, 50 LF of wooden footbridge, in Wake County North Carolina. The work shall include, but is not limited to, grading, greenway, footbridge, erosion control, and traffic control. All work includes labor, equipment, materials, supervision, and equipment to complete the project. Interpretations or clarifications considered necessary by Town/Engineer in response to such questions will be issued by Addenda delivered to parties recorded by Town as having received the Bidding Documents. Questions received less than five (5) working days prior to the date for opening of Bids may not be answered. Only questions answered by formal written Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect. Each bidder shall ascertain prior to submitting his Bid that he has received all Addenda issued, and he shall acknowledge their receipt with his Bid.
