Description: Asbestos/Lead/Mold/PCB Abatement. Bond Requirements
A. In connection with its Bid, the Contractor provided an appropriate bid bond/certified check, in
the amount specified for this Requirement Contract.
B. Contractor has obtained and agrees to maintain in effect for the Performance Period a
Construction Performance Bond on the form attached hereto as Appendix D, for the amount
specified for this Requirement Contract.
C. Contractor has obtained and agrees to maintain in effect for the Performance Period a Labor &
Materials Payment Bond on the form attached hereto as Appendix E, for the amount specified
for this Requirement Contract. Performance Period: 1095 Continuous Calendar Days. Requirements Contract Award Amount Not to Exceed: Nine Million ($9,000,000) Dollars. Failure of the Contractor or a Subcontractor to comply with these Apprenticeship Training Requirements during the Contract Performance Period may result in, among other things, an “unsatisfactory” evaluation and/or an assessment of special liquidated damages against the Contractor in the amount of two hundred ($200) dollars for each continuous calendar day following the Contractor’s receipt of a written SCA notice that it and/or a subcontractor are out of compliance with an applicable Apprenticeship Training Program Agreement. The SCA may assess liquidated damages until such time that the Contractor and/or its subcontractor(s) are again covered under NYS-approved Apprenticeship Training Program Agreements.
