Hunt Elementary School: Restroom Building. Performance Bond in the amount of one hundred percent (100%) of the contract sum to insure Owner during construction and for one year after completion against faulty or improper materials or workmanship and to assure Owner of full and prompt performance of contract and shall be secured from a California based surety or sureties satisfactory to the Owner. Contractor's Bond (Labor and Material) in the amount of one hundred percent (100%) of the contract sum in accordance with the laws of the State of California to secure payment of any and all claims for labor and materials used or consumed in performance of this contract and shall be secured from a California based surety or sureties satisfactory to the Owner. The amount of liquidated damages to be paid by the Contractor to the Owner for failure to complete the work specified will be $500.00 for each calendar day by which completion of the project is delayed beyond the Fixed Completion Date and continuing thereafter to the time at which the Project is completed such amount being in each case the actual cash value agreed upon as the loss to the Owner resulting from the Contractor's default. A valid B-1, contractor's license will be required. Time is of the essence in this contract, and all work called for herein and all requirements shall be completed within 270 (two hundred seventy) calendar days.
