Automatic Transfer Switches Cashier Check or Bid Bond of 5% of Total Amount of Bid. For any clarifications, please contact Hugo E. Lopez at the Brownsville Public Utilities Board, Purchasing Department at (956) 983-6364 or (956) 983-6375 e-mail: hlopez@brownsville-pub.com Each bid shall constitute an offer to the Board, as outlined therein, and shall be irrevocable for at least ninety (90) days after the time announced for the opening thereof. Bidder is required to execute a contract and furnish a Material Supply Bond. The supply bond shall be valid from the notice of award until the acceptance of the Automatic Transfer Switches. Additionally, in lieu of supply bond, a letter of credit (LOC) from a Texas institution is acceptable. If the successful firm fails to execute the contract and to furnish a satisfactory Supply Bond within 10 days from the date on which he is notified that his bid has been accepted, the amount of his check or supply bond shall be forfeited to the Brownsville PUB as mutually agreed to liquidated damages, and not as a penalty. The BPUB specifically reserves the right to reject any or all bids, to waive irregularities or informalities in any or all bids and to accept any bid which is deemed to be in the best interest of the Board.
