The City of Follansbee (Owner) is requesting Bids for the construction of the following Project: Contract No. 2 - Wastewater Treatment Plant Improvements The Project includes the following Work: Contract No. 2 The Work includes the improvements to the existing grit removal equipment by replacing the existing grit pump and grit classifier; removal and replacement of mixing equipment in Oxidation Ditch No. 1; removal of existing aeration/mixing equipment in the existing Aerobic Digester; repairs to the existing Digester concrete basins; relocation of existing emergency generator; installation of new emergency generator; electrical; and all other associated work. Prospective Bidders may obtain the Bidding Documents at the Issuing Office (the office of Ghosh Engineers, Inc.) on Monday through Friday between the hours of 8:00 am to 4:00 pm. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including addenda, if any, obtained from sources other than the Issuing Office. A certified check made out to the City of Follansbee, or a Bid Bond executed by the Bidder and Bidder's surety company approved by the City of Follansbee, in the amount equal to five percent (5%) of the bid, shall be submitted with each bid. No bid shall be waived or returned because the bidder failed to or cannot comply with any requirements as set forth in the Plans, Specifications, or any applicable statues of the United Sates, the State of West Virginia, and/or local ordinance. The Bid package must be submitted in two (2) envelopes. The envelopes must contain the following: Envelope No. 1 a. Bid Bond b. Certification of Bidder Regarding Equal Employment Opportunity c. Copy of Current West Virginia Contractor's License d. Certification of Non-Segregated Facilities e. Drug Free Workplace Affidavit f. Acknowledgement of Receipt of Addenda to Plans, Specifications and Contract Documents g. American Iron & Steel Certification Envelope No. 2 a. Bid Form Nondiscrimination of Employment Bidders on this work will be required to comply with the President's Executive Order No. 11246, the requirements for bidders and contractors under this order are explained in the specifications. Contractor's License All bidders are required to have a West Virginia Contractor's License per Section 21-11-11 of the West Virginia Code. The funding for this project requires contractors to conform to the requirements of the "American Iron and Steel (AIS)" requirements of section 436 of P. L. 113-76, Consolidated Appropriations Act, 2014. Any bidder submitting a bid must provide the AIS certification included in the bid package. West Virginia Code 21-1D-5 provides that any solicitation for a public improvement construction contract requires that each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The enclosed Drug Free Workplace affidavit must be signed and submitted in the first envelope as evidence of the vendor's compliance with the provisions of Article 1D, Chapter 21 of the West Virginia Code. Failure to submit the signed Drug Free Workplace affidavit in the first envelope shall result in disqualification of such bid. Suspension and Debarment Recipients shall not entertain the use of businesses that are listed on the "System for Award Management (SAM)" at www.sam.gov in accordance with 2 CFR Part 1532 and Sub-part B and C of CFR Part 180. Contractors are required to comply with all the laws pertaining to federal wage rates issued in accordance with the Davis Bacon Act. The Time of Completion for Contracts 2 and 3 shall be 365 consecutive calendar days each beginning with the Award of Contract and written Notice to Proceed. For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents. B&O Tax are applicable for this project. The B & O tax rate is 0.814% and the successful bidder shall complete and submit the B & O tax form to the City.
