Orange County, Florida, henceforth referred to as the County is accepting sealed offers for Temporary Labor Services - Utilities Maintenance Technician (Y24-1113) Scope of Services: Overview Contractor shall provide temporary labor for both long-term and short-term assignments to assist in meeting the employment needs of the County. The selected Contractor shall provide qualified, experienced personnel in accordance with the requirements outlined herein. The Contractor shall be the legally responsible employer for the temporary personnel during the time they are assigned to work at the County. In no event shall the County be considered the co-employer of the Contractor's personnel engaged under this contract. Scheduling of Services 1. Non-Emergency Services Upon request by the County, the Contractor shall provide resumes for proposed positions within one week from receipt of request by the County. The Contractor shall provide details on the qualifications, experience, and expertise of the particular individual(s) who will perform the work. The Contractor shall include a comprehensive resume that details the individual's experience, education, training, technical experience, and applicable certifications. Upon receipt of the written notice packet, as outlined above, the County Project Manager will review the submittal for approval and determine if the qualified individual(s) meets or exceeds the requirements specified herein. The County Project Manager will then provide the Contractor with dates to schedule an interview for the proposed technician(s). All candidates selected by the County post interview shall have passed a background check and drug test prior to date of scheduled work, unless otherwise approved by the County Project Manager or authorized designee. All cost associated with the background check and drug test shall be at the expense of the Contractor. Upon approval and completion of the interview, the County Project Manager will notify the Contractor and/or selected individuals in writing. The Contractor's personnel shall report to the assigned County department prior to the start of the work shift. Emergency Services: Upon request by the County, the Contractor shall provide resumes within 48 hours of verbal notification. The Contractor shall maintain a dedicated telephone line for normal business hours and emergency requests from the County. Failure to respond to emergency within the time requirements may result in contract cancellation. For the duration of this contract, the Contractor shall have an assigned Account Representative to handle all points of communication including requests, invoice questions, and customer service. Contractor Responsibilities Background Check: At the expense of the Contractor, personnel selected to work within Orange County shall pass a minimum Level II background check. Level II background check includes: Identification Verification Selective Service Status (registered/unregistered) Clerk of the County of Residence Employment Verification DMV by state of residence Military Service Verification Professional License & Certification Check Fingerprint Check Credit/Fraud Check Drug Test: At the expense of the Contractor, personnel selected to work within Orange County shall pass a drug screening test. Copies of all reports shall be provided to the County Project Manager within 24 hours of receipt of County request. Uniforms: The Contractor shall ensure all of its employees assigned to work for the County are clean and neat in appearance and without holes or excessively worn out. Uniform requirements for all assignees shall consist of the following: Utility Pants Polo Shirt with no adornment Applicable safety shoes or boots Employee Rates and Time Tracking All hourly rates shall be burdened to include all costs associated with providing services specified herein including but not limited to overhead costs, mileage, travel, and profit. Attention: These rates should not be the rate listed on the bid form. The rates on the bid form shall be inclusive of all overhead, profit and expenses. Hours worked by the assignee shall be confirmed on a weekly basis via signature of the County Project Manager or authorized designee. The County will pay only for actual hours worked. Billable hours shall only include hours worked during the assigned/scheduled work shift. Travel time to and from the assigned reporting location shall not be billed. Overtime will be permitted, upon authorization by County Project Manager or authorized designee. Failure by the assignee to obtain pre-approval by the County for overtime worked may result in non-payment of services by the County. Overtime shall be defined as approved service hours over forty (40) per assignee, per week. Holiday billing shall be paid to employee by contractor. There are ten (10) paid holidays per calendar year. The County will provide the following for full, eight (8) hour work shifts: Two (2), paid, fifteen-minute breaks; one during the morning hours and one during afternoon hours One (1), unpaid, one (1) hour lunch break Benefits and Expenses The Contractor shall be responsible for, and will not be reimbursed by the County for any employee benefits provided to its employees. This shall include any provisions for travel expenses, training programs, cellular phones (if required). Parking space will be provided by the County. If an assignee qualifies for vacation under their employment contract with the Contractor, that assignee shall give the County two (2) weeks' notice before the start of such vacation. The Contractor shall be responsible for any vacation pay due to their employee and will not be reimbursed by the County. Additionally, if the assignment is ongoing at the time of employee's vacation, the Contractor shall provide a replacement assignee as approved by the County. The Contractor shall ensure there is no lapse of continuity of service. County Responsibilities The County will provide all necessary personal protective and safety equipment including but not limited to safety vests, ear plugs, sound protection gear, and safety glasses for use by the assignee. All county issued equipment shall be turned in by the assignees at the end of each work assignment or workday. The County will provide all tools and equipment necessary to accomplish the work assigned. All tools and equipment shall be accounted for and turned in by the assignee at the end of each work assignment or workday. The County will provide access to restroom and hand washing facilities either at the designated work site or by transport to the nearest facility. Professionalism and Unsatisfactory Service The Contractor's personnel shall adhere to the same professional and ethical standards of conduct required of County personnel while performing their assigned duties. The County reserves the right to dismiss and if deemed necessary, escort from County property for any assignee who fails to adhere to County standards, policies, and procedures including, but not limited to: use of alcohol or controlled substances while on duty or being under the influence of such substances when reporting to work; using profanity or being verbally abusive; disobedience of reasonable directions given by the supervisor or designated representative; violation of safety rules and regulations. If dismissed before commencing work, billing for that assignee will not be accepted. The Contractor shall provide a replacement immediately upon notification by the County for start of the next business day, unless otherwise approved by the County. Joint Employment The County will not be considered a joint employer of the Contractor's personnel under this Contract. Furthermore, the County will not be liable either jointly or severally, for violations of the Fair Labor Standards Act (FLSA). Right to Hire The County reserves the right to hire any assignee on a part time or full time basis, without penalty or fees to the Contractor, after they have completed four-five (45) working days of continuous service. Job Descriptions Maintenance Technician: Job Duties Work may include, but not be limited to: Checks and maintains assigned facility equipment or systems for preventative maintenance and critical operation factors. Maintenance and repair of Commercial/Industrial buildings Replacing lighting, ballast, fixtures, lamps, etc. Repairing, prepping, and painting drywall Replacing/adjusting closures, locks, hinges and handles on commercial steel door systems Pressure washing Repair, installation and maintenance of commercial plumbing services such as closet and urinal diaphragms and flush valves Performing preventative maintenance of all types of equipment. Troubleshoot and diagnose electrical, HVAC and plumbing problems Loading and unloading materials up to 40 lbs. Working off a ladder up to 12 feet high and in a lift up to 60 feet Maintenance Technician II: Job Duties Work may include, but not be limited to: Maintenance and repair of /Industrial buildings 5 years minimum in electrical, plumbing or HVAC trade. Preferred candidate will have journeyman license Repairing, prepping, and painting drywall Pressure washing Replacing lighting ballast, fixtures, lamps, etc. Replacing/adjusting closures, locks, hinges and handles on commercial steel door systems Repair, installation and maintenance of commercial plumbing services such as closet and urinal diaphragms and flush valves Performing preventative maintenance of all types of equipment. Troubleshoot and diagnose electrical, HVAC and plumbing problems Loading and unloading materials up to 40 lbs. Working off a ladder up to 12 feet high and in a lift up to 60 feet Maintenance Person: Job Duties Work may include, but not be limited to: Checks and maintains assigned facility Pressure washing Painting and minor drywall repairs Performs miscellaneous duties but not limited to cleaning roofs of debris, pulling weeds, etc. Parking lot cleaning Ability to perform heavy manual labor under adverse weather conditions. Loading and unloading materials up to 45 lbs. Working off a ladder up to 12 feet high and in a lift up to 60 feet It is the respondent's responsibility to ensure they commence their upload efforts timely to meet the submission deadline. The County shall not be responsible for delays caused by any occurrence, including the respondent's network delays, bandwidth issues, internet outages, or technical difficulties. Question Deadline 08/08/2024 at 5:00 PM ET Timely questions concerning this solicitation shall be submitted in accordance with the deadline for questions. Respondents are instructed not to contact the initiating division directly. Answers for timely questions will be addressed electronically. Beyond questions and answers, any and all modifications, clarifications, interpretations and supplemental instructions will be in the form of a written addendum which, if issued, will be available for obtain. Consideration for modification or alteration of the documents contained in this solicitation shall be requested during the specified question period, before the applicable deadline. No oral interpretation of the meaning of the plans, specifications, or other Contract documents shall be considered binding. The County shall be bound by information and statements only when such statements are written and executed under the authority of the Manager, Procurement Division. All addenda and questions/answers so issued shall become part of the Contract Documents and receipt shall be acknowledged as specified herein. This provision exists solely for the convenience and administrative efficiency of Orange County. No respondent or other third party gains any rights by virtue of this provision or the application thereof, nor shall any respondent or third party have any standing to sue or cause of action arising there from. Untimely questions are unable to be submitted in the question and answer module, thereafter respondents raising critical concerns must email jenna.allen@ocfl.net. Critical clarifications may be made via addenda, however, untimely questions may not be considered. For the duration of the contract, any changes in the terms and conditions shall be reduced to writing as an amendment to this contract and such amendment shall be executed by both parties. A bid shall constitute an irrevocable offer for a period of one hundred twenty (120) days from the public opening date or until the date of award. In the event that an award is not made by the County within one hundred twenty (120) days from the public opening date, the respondent may withdraw their offer or provide a written extension without modification. Acceptance/Rejection/Cancellation The County reserves the right to accept or to reject any or all offers and to make the award to that respondent who, in the opinion of the County, will be in the best interest of and/or the most advantageous to the County. The County also reserves the right to reject the offer of any respondent who has previously failed in the proper performance of an award, to deliver on time contracts of a similar nature, or who, in the County's opinion, is not in a position to perform properly under this award. The County reserves the right to inspect all facilities of respondents in order to make a determination as to the foregoing. The County reserves the right to waive any irregularities and technicalities and may, at its discretion, request a re-solicitation. Award will be made to the lowest responsive and responsible respondent as determined by the County. The County reserves the right, and the Manager, Procurement Division has absolute and sole discretion, to cancel a solicitation at any time prior to approval of the award by the Board of County Commissioners when such approval is required. The decision to cancel a solicitation cannot be the basis for a protest pursuant to the Orange County Code.
