This contract will apply to the inventory of Fire Alarm Panels and Automatic Water Based Fire Sprinkler Systems and all associated components as are presently found within 85 City Facilities; the Preventative Maintenance has been separated into multiple groups (Attachments G-M) which the vendor may submit a proposal for an individual group, multiple groups or all. Should the ITM service inventory increase or decrease during the term of this contract, appropriate price adjustments will be made in consultation with the contractor. FCM would prefer to establish a single annually renewable contract for services, but in the event that no single vendor can provide comprehensive service for all groups, multiple contracts may be awarded. Other fire safety sub-systems, such as range kitchen hoods suppression system, portable extinguishers, and computer room systems (Special Hazards), are not included in the enclosed Scope of Work as they will be additional Inspection, Testing, and Maintenance for these systems. Negotiated price adjustments will be made at that time. Services provided by the Contractor(s) may be funded with federal monies from Housing and Urban Development (HUD) grants and are subject to the terms and conditions included herein. These terms and conditions cannot be modified or negotiated. By submitting a proposal, Offeror must agree to abide by the applicable federal terms and conditions included. If a party to this Contract has reason to question, in good faith, the other party's intent to perform, the former party may demand that the other party give a written assurance of their intent to perform. In the event that a demand is made and no written assurance is given within 5 business days, the demanding party may treat this failure as a default. The City may from time to time during normal business hours, at the City's expense, inspect the Contractor's or any subcontractor's place of business at which work under this Contract is being performed.
