The building is currently vacant and prepared for modifications. The intent is to retain the existing walls where possible and convert the space into a functional EOC. The EOC will consist of a single-story structure of approximately 4,200 square feet. The space will include a central emergency operations room, two multi-purpose rooms, communications device/storage room, cold kitchen, kitchenette storage area, two private showers, sufficient numbers of restrooms, and an IT server room. Other appurtenances include but are not limited to a hard-wired emergency backup power generator capable of carrying full load of all site/station circuits, all furniture, fixtures, equipment, house HVAC assessment, roofing, mini split for IT server room if needed. City to provide final approval on furniture, fixtures, paint, aesthetics, etc. The project will also include all material, labor, special observation, inspection, testing, verification, procurement and installation of all furniture, fixtures, and IT-related infrastructure. D-B E will be responsible for obtaining all required permits, including federal, state, and local governance as well as coordination with all utilities and other regulatory agencies, start-up and commissioning required for occupancy and operations. The final proposal must be the total cost for delivery of the entire project and all of its related elements, and no further payment will be allowed, therefore. The successful D-B E will be afforded latitude in its proposal for EOC design but must meet certain specifications and requirements stipulated by the City. Requirements include room types, furniture type, color scheme, and delivery date. Bidder/Proposer acknowledges and understands that it is bidding/proposing on a project with a source of funding coming from the Coronavirus State and Local Fiscal Recovery Funds established under the American Rescue Plan Act (31 CFR Part 35) (ARPA). With ARPA funding the regulations dictate, among other things, the purpose, eligible use of the funds, and compliance with specific reporting requirements. All of these can be found at 31 CFR Part 35 (Regulations), which Regulations are incorporated herein and made a part of this Request for Bids/Proposals. Said regulations will also be incorporated into the contract with the successful bidder. Bidder/Proposer by submitting a bid/proposal is agreeing to be bound by the requirements set out in the Regulations. This includes submitting quarterly reports by the 15th of the month following the end of each quarter to the Director of Finance. The reports must include, but is not limited to, the use of the funds, documentation/receipts of the funds spent, description of the project and status of completion of the project. In addition to compliance with ARPA, as a recipient of federal funds, the Bidder/Proposer, and any and all of its subcontractors, must ensure that they do not deny benefits, services or otherwise discriminate on the basis of race, color, national origin (including limited English proficiency), disability, age, or sex (including sexual orientation and gender identity) in accordance with Title VI of the Civil Rights Act of 1964, Public Law 88-352, 42 U.S.C. 2000d-1 et seq., and the Department's implementing regulations, 31 CFR part 22; Section 504 of the Rehabilitation Act of 1973 (Section 504), Public Law 93-112, as amended by Public Law 93-516, 29 U.S.C. 794; Title IX of the Education Amendments of 1972 (Title IX), 20 U.S.C. 1681 et seq., and the Department's implementing regulations, 31 CFR part 28; Age Discrimination Act of 1975, Public Law 94-135, 42 U.S.C. 6101 et seq., and the Department implementing regulations at 31 CFR part 23. Bidder/Proposer will also be required to submit data showing compliance with the above. Bidder/Proposer, in any contract issued, will also be required to comply with Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards found at 2 CFR Part 200 Appendix II. The Project will be located at 38255 9th Street East, Palmdale, CA 93550. In addition to constructing a fully furnished and functional EOC, proposals shall include all costs for labor, materials, supervision, general conditions, mobilization, furniture, fixtures, IT equipment, special inspections, and any/all fees, including all applicable design, regulatory compliance applications and permits. In no event shall the Guaranteed Maximum Price (GMP) exceed $3,300,000. The GMP represents the maximum total available funding for contract award of the base scope of work. The base scope of work is defined in the Scope of Work (SOW). Unless otherwise prescribed as an "Alternate," all work defined in this RFP and its attachments, and appendices including the BOD shall be considered the base scope of work. The GMP shall include all of the cost detail and breakdown as defined in the Price Proposal form. The Price Proposal must represent and include all items of the Technical Proposal and Performance Criteria and remain valid for 180 calendar days after the proposal due date and time. The design and construction of the facility shall be completed in a Guaranteed Maximum Price (GMP) contract and include all requirements set forth in this RFP. This is not to be construed as a stipulated sum subject to change, but rather a true guaranteed not-to-exceed maximum cost.
