“The owner has selected West Coast Air Conditioning Company Inc for the Construction Manager. A timeline for construction has not yet been established.” All RFP questions must be posted via the Countys online bidding system and are due by 2:00pm on August 20, 2024 Project Location: 525 N. Flower Street in Santa Ana, CA. Orange County is seeking proposals from General Contractors to provide Construction Manager (CMAR) services with a negotiated Guaranteed Maximum Price for the design phase and a Guaranteed Maximum Price for the contractor phase for the CONSTRUCTION MANAGER AT RISK (CMAR) FOR UREA CONVERSION PROJECT Project, which is located at 525 N. Flower Street, Santa Ana CA 92703. The County has developed the project construction documents. The classification of the CMARE's licenses required in the performance of this Contract are Class A, B. The budget estimate is approximately 1600000 for this project. The delivery method for this Project is Construction Manager (CMAR) and will consist of a design phase and a construction phase. The CMARE will collaborate with the County's in-house Project Manager and external Engineering Firm on the design, constructability, cost, project approach and schedule of the Project throughout the life of the Project. The County intends to award a contract using best value method to a Respondent that possesses or obtains sufficient bonding for the Project construction phase services and risk and liability insurance as required. The County intends that the successful CMARE shall provide design and construction services for a negotiated GMP(s), as proposed in accordance with contract requirements set forth in RFP Sections below titled: Model Contract-Design Phase Services and Model Contract-Construction Phase Services. The Contract will be a negotiated GMP for design phase services between the County and the selected CMARE. The County may, at its sole discretion, exercise its option to negotiate a GMP for the construction of the Project with the CMARE and shall execute the construction services contract at a later date. In accordance with Government Code Section 53069.85, CMARE agrees to forfeit and pay to County the sum of 1000 per day for each calendar day that completion of all the work required by the Contract Documents is delayed beyond the Contract Time, or specified portion of work if designated in a GMP, as may be adjusted by Change Order. County may deduct such sum from any payments due to or to become due to CMARE. If the Liquidated Damages exceed the unpaid balance of the Contract Price otherwise owed to CMARE, then CMARE shall immediately pay County the difference. Within 10 days after award of the Contract, CMARE shall furnish a payment bond for 100% of the amount of the Contract, in accordance with Civil Code Section 9554, and a performance bond for 100% of the amount of the Contract, guaranteeing the faithful performance of the Contract. CMARE shall take steps to assure that the penal sum of the bonds shall be increased by the amount of any additive adjustments to the Contract Price as a result of Change Orders. The payment and performance bonds must each be issued by a surety that: (i) is authorized by the California Insurance Commissioner to transact surety insurance in the State of California; (ii) has assets exceeding its liabilities in an amount equal to or in excess of the amount of the bonds; and (iii) acts in compliance with Insurance Code Section 12090. The payment and performance bonds shall be in the form provided with the Instructions to Bidders and are subject to approval by the County.
