Each bid shall be accompanied by bid security made payable to the Owner, in the amount of five percent (5%) of the bid sum. Security shall be either, certified check, cashier's check, bank money order or bid bond issued by surety licensed to conduct business in the State of Illinois. Successful bidder's security will be retained until he has signed the contract and furnished required payment and performance bonds. Owner reserves the right to retain security of the next two (2) lowest bidders until the lowest bidder enters into contract or until thirty (30) days after bid opening, whichever is shorter. All other bid security will be returned as soon as practicable. If any bidder refuses to enter into a contract, Owner will retain bid security as liquidated damages, but not as a penalty. Contract Time: Time of Substantial Completion for the project shall not be later than 180 consecutive calendar days from date stipulated in written Notice to Proceed. Owner reserves the right to reject any or all bids or any part thereof, to waive any informality in bidding and to accept bids deemed most favorable to the Owner.
