Renovation of a water / sewer project in Hempstead, New York. Completed plans call for the renovation of a water / sewer project.
General Construction Allowance for providing miscellaneous additional work at the site as directed by the Engineer. Each proposal must be accompanied by a certified check or bid bond payable to the Town of Hempstead for not less than 5% of the estimated amount of the bid. Federal equal opportunity and labor standards are applicable for all work performed under this Contract. The Town of Hempstead reserves the right to reject any or all bids. All bidders please be advised that this project may be funded entirely or at least in part from an assistance agreement between New York State Environmental Facilities Corporation (NYSEFC) and the Town of Hempstead. In accordance with State, local or tribal laws and regulation as well as the terms and conditions set forth in the NYSEFC documents included in the specifications, all bidders shall acknowledge the requirements and provisions for construction contracts including, but not limited to: participation goals for Minority and Women Owned Businesses and Service-Disabled Veteran Owned Businesses. Performance Bond & Labor & Materials Bond The successful bidder, simultaneously with the execution of the Contract will be required to furnish a faithful performance bond in an amount not less than one hundred percent (100%) of the Contract amount and a labor and materials payment bond (for payment of all persons performing labor or furnishing materials in connection therewith) for not less than one hundred percent (100%) of the Contract amount. Said bonds to be issued by a Surety Company acceptable to the Owner or securities approved by the Owner and in a form satisfactory to the Owner and covering all points in this agreement, bearing the date herewith and forming part of this Contract (See TF-6, TF-6a, TF-7 and TF- 7a). and in a form satisfactory to the Owner and covering all points in this agreement, bearing the date herewith and forming part of this Contract (See TF-6, TF-6a, TF-7 and TF- 7a). All bonds shall be issued by a Surety Company listed in a most recent copy of the Department of the Treasury Federal Register, Circular #570. Amounts of said bonds shall not exceed limits set by the aforesaid federal register. (See TF-6 & TF-7). The bidder whose proposal has been accepted will be required to appear at the Office of the Town Attorney with required executed Surety Company bonds and insurance coverage; and execute the Contract within ten (10) days from the date of the service of a notice (see TF-5), delivered to him in person or mailed to the address given in the proposal, that the Contract has been awarded to him. In case of failure to execute the Contract (including the required bonds and insurance) within the time stated, the bidder shall be deemed to have abandoned the Contract, and the amount of the bid deposit made by the bidder will be forfeited and retained by the Owner as liquidated damages. The agreement form is attached (see TF-8 and TF-8a). The successful bidder will be required to guarantee the work for a period of one (1) year from the date of final acceptance, against any and all omissions and defects which may develop or require attention as a result of his performance of the Contract. The Town Board reserves the right to reject any and all bids and to waive any informalities in the bids received and to accept the bid most favorable to the interest of the Owner, after all bids have been examined and checked.
