All Bids shall be accompanied by a Bid Bond in an amount of not less than five percent (5%) of the bid for the complete work. The Bid Bond shall be forfeited to Henry County, Georgia as liquidated damages if the Bidder fails to execute the Contract and provide Performance and Payment Bonds within fifteen (15) calendar days after being notified that he has been awarded the Contract. The Bid Bond shall be in the form of a surety issued bond made payable to the Henry County Board of Commissioners. The Surety Company shall be licensed to do business in the State of Georgia and listed in the Department of the Treasury Circular 570, latest edition. The Surety Company shall have an A.M. Best Company minimum rating of "A" with a financial size of VI "6" or better. Payment will be made monthly on completed work. Retainage will be held by Owner to a maximum of ten percent (10%) of each progress payment. The Bidder is expected to examine the site(s) of the proposed work, the Proposal Form, Specifications, Supplemental Specifications, Special Provisions and Contract forms before submitting a bid. Qualifications of the Bidder will be reviewed before Award of the Contract. The Work on this project shall be completed within two hundred and forty (240) calendar days after receipt of the written Notice to Proceed. The Contractor shall furnish all labor, materials, equipment, and services required to fulfill the terms and conditions of this bid. Bids will only be considered by those bidders and subcontractors currently pre-qualified with the Georgia Department of Transportation. Contractors must also be currently registered and active with online. This project will be funded or partially funded with Community Development Block Grant (CDBG) funds. The selected contractor must comply with federal laws and regulations including but not limited to provisions covering Equal Employment Opportunity, the Copeland Anti-Kickback Act, the Davis Bacon Act, Section 3 of the Housing and Urban Development Act of 1968, the Contractor Work Hours and Safety Standards Act, the Rights to Inventions Made Under Contract or Agreement, the Clean Air Act, The Byrd Anti-Lobbying Amendment, The Build America Buy America (BABA) Act, Debarment and Suspensions, and the Drug-Free Workplace Requirements. All work shall be completed in accordance with Georgia Department of Transportation Standard Specifications Construction Of Transportation Systems, 2021 Edition (as amended). Bids may not be withdrawn for sixty (60) days after the time and date set for closing, except as allowed by OCGA.
