Renovation of a theater / auditorium in Guadalupe, California. Completed plans call for the renovation of a 13,019-square-foot theater / auditorium.

GENERAL WORK DESCRIPTION: The scope of work includes the historic renovation of the Royal Theatre to California Historic Code; the new construction of a three-story performing arts building; and landscape work, which includes an amphitheater, parking lot, and a plaza. ECONOMIC DEVELOPMENT ADMINISTRATION: This project will be partially funded with Federal funds from the United States Department of Commerce, Economic Development Administration (EDA) and therefore is subject to the Federal laws and regulations associated with that program. BUILDING CODES: Title 24 California Code of Regulations California Health and Safety Code Accessibility and ADA Requirements California Historic Code WORK SCHEDULE: Work must be completed within 288 working days (calendar days are 420) from the Notice to Proceed. PROPOSALS: Proposals must include all work described within this document and shown within the Plans and Specifications. Proposals must be made on the proposal forms furnished with this document. All other proposal forms will be rejected. Attention to prospective bidders is called to Section 2, "Proposal Requirements and Conditions," within this document, for full direction as to bidding and other items. The City of Guadalupe reserves the right to reject any or all proposals or make the award to the lowest responsible bidder. Notice is given to all bidders that no more than 50% of the work, as defined by the contract price, may be done by subcontractors. Notice is also hereby given that all Bidders may be required to furnish a sworn statement of their financial responsibility, technical ability, and experience before an award is made to any Bidder. The successful Contractor will be required to obtain a business license from the City and pay related fees. The right is reserved by the City of Guadalupe to reject any or all Bids, to evaluate the Bids submitted, and award the contract to the lowest responsive and responsible Bidder. The City further reserves the right to waive any informalities or minor irregularities in the Bid. BONDS: Each proposal must be accompanied by cash, a certified or cashier's check, or bidder's bond of the prescribed form and made payable to the City of Guadalupe for an amount equal to at least ten percent (10%) of the bid amount, such guaranty to be forfeited, should the bidder to whom the contract is awarded fail to furnish the required bonds and to enter into a contract with the City within ten (10) days after awarding of the contract. The successful contractor will be required to furnish three (3) acceptable surety bonds: one for faithful performance, one for labor and materials, and the other for maintenance following construction. Each bond is to be executed in a sum equal to one hundred percent (100%) of the contract price, except that the maintenance bond shall be for ten percent (10%) of the contract price and shall remain in effect for one year following acceptance of the project for final payment. As a federally funded (Economic Development Administration) project, bidders must use this link for a list of acceptable surety bond companies. LICENSE REQUIREMENTS: In accordance with provisions of California Public Contract Code Section 3300, the City has determined that the Contractor shall possess a valid Class A and Class B license at the time of award. The Contractor shall be properly licensed at the time the contract is awarded. No contract will be awarded from a Contractor who has not been licensed in accordance with the provisions of Chapter 9 of Division 3 of the California Business and Professions Code. PREVAILING WAGE RATES: Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in the County of Santa Barbara, in which the work is to be done have been determined by the Director of the California Department of Industrial Relations. These wages are set forth in the General Prevailing Wage Rates for this project, available from the California Department of Industrial Relations' Internet web site. Additionally, as a federally funded construction project, Wage rates paid for labor must not be less than the prevailing wages for County of Santa Barbara, as determined by the U.S. Secretary of Labor and must be embodied in the construction contract pursuant to the requirements of the Davis-Bacon Act, as amended (40 U.S.C. 3141 et seq.). The greater of the two wage rates, per classification, must be used. The Contractor will be required to maintain and distribute certified payroll records in compliance with Section 1776 of the California Labor Code and the Davis-Bacon Act, as amended (40 U.S.C. 3141 et seq.). RETENTION: The Contractor may elect to receive 100 percent of payments due under the Contract Documents from time to time, without retention from any portion of the payment by the City, by depositing securities of equivalent value with the City in accordance with the provisions of Section 22300 of the California Public Contract Code. Such securities, if deposited by the Contractor, shall be valued by the City, whose decision on an evaluation of the securities shall be final. Securities eligible for investment under this provision shall be limited to those listed in Section 22300 and Section 16430 of the California Government Code. Also see Section 6-10 of this document.
