2024 Asphalt Resurfacing project Principle items of work include: Approximately 27,000 square yards 2.5-inch thick asphalt mill & overlay, approximately 455 tons of pavement edge wedge, approximately 4,100 square yards of 1.5-inch asphalt overlay, approximately 7,000 square yards of 2 inch asphalt overlay, approximately 2,700 square yards of edge milling, approximately 210 tons of full depth asphalt patching, approximately 11,200 linear foot of 4 inch double yellow pavement markings, approximately 14,312 linear foot of 6 inch white pavement markings, approximately 70 linear foot of 12 inch white pavement markings, approximately 80 linear foot of 24 inch white pavement markings, 2 right turn arrow markings, 4 left turn arrow markings, 2 straight arrow markings, 2 "ONLY" pavement markings, 4 Manhole adjustments. A complete set of paper Bid Documents may be obtained by a prospective Bidder by sending a non-refundable cash deposit of Twenty Five Dollars ($25.00), along with a written request for said set of documents Addressed to the City Engineer, City of Great Bend, P.O. Box 1168, Great Bend, Kansas 67530. Each Bidder shall acquaint himself with all conditions pertaining to the proposed Work; shall carefully examine the site. The Bidder shall fully inform himself as to the quality and quantity of materials required and the character of the work. No additional compensation will be granted because of any unusual difficulties, which may be encountered in the execution or maintenance of any part of the Work. Any prospective Bidder in doubt as to the true meaning of any part of the Contract Documents may submit to the Engineer, a written request for an interpretation thereof. Official interpretation, modification, or revision of the Contract Documents will be made only by Addendum, duly issued and mailed or delivered to each party having a set of the applicable Contract Documents. When the work is a Lump Sum Contract, the quantities in the Bid form are to be considered as exact. When the work is not under a Lump Sum Contract, the quantities listed in the Bid form are to be considered as approximate and are to be used only for the comparison of Bids. Payment to the Contractor will be made only for the actual quantities of work performed in accordance with the applicable Contract Documents. Should the final estimate of quantity show an increase or decrease from the original quantities indicated, the unit price stated in the Bid will prevail. The Owner reserves the right to increase or decrease any or all of the quantities shown in the Bid form, provided the money values of such increases or decreases or omissions does not exceed 20% of the principal Contract Price, without in any way invalidating the Bid Prices. This project is not under a Lump Sum Contract. The best bidder shall be selected based on the total bid price based on the quantities, unit prices, and bid extensions shown on the bid proposal. No qualifying bids shall be allowed. The lands upon which the Work is to be performed, rights-of-way and easements for access thereto and other lands designated for use by the Contractor in performing the Work are identified in the Drawings and/or the Specifications. The Contractor shall be responsible for the acquisition of any additional temporary easements or rights-of-way that are desired to be used to complete the work. Contractor shall furnish documentation regarding any additional agreements for additional work areas prior to commencing with Work in such areas. Underground Facilities: Information and data shown or indicated in the Bidding Documents with respect to existing Underground Facilities at or contiguous to the Site are set forth in the Contract Documents and are based upon information and data furnished to The City of Great Bend and The City of Great Bend Assistant Engineer by the owners of such Underground Facilities, including The City of Great Bend, or others. Each Bidder shall submit with his Bid, a certified check, cashier's check or an acceptable bid bond in the amount of 5% of the total Bid shown on the Bid form. This security shall be made payable to the Owner and will serve as a guarantee that the Bidder will file all bonds, certificates of required insurance and enter into any contract awarded him, in accordance with the terms of his Bid, within 10 days after certification of award. Should the successful Bidder or Bidders fail to enter into the Contract with the Owner and file all required bonds and certificates of Insurance, their respective bid securities shall be forfeited as liquidated damages and the money derived therefrom will be turned to the use of the Owner. The Contractor shall be required to identify all his subcontractors on the bid form. The City reserves the right to review the qualifications of the subcontractors. Award of the contract shall be contingent on the qualifications of the Contractor and his subcontractors as well as the low bid. Bids shall be submitted at the time and place indicated in the Invitation for Bids and shall be included in an opaque sealed envelope marked with the Project title and name and address of the Bidder and accompanied by the Bid Security and other required documents. If the Bid is sent through the mail or other delivery system, the sealed envelope shall be enclosed in a separate envelope with the notation "BID ENCLOSED" on the face thereof. Bids received after the closing time indicated in the Advertisement for Bids will be rejected and returned unopened. The Bid form provided by the Owner shall be filled out in full. Bids for less than all Work will not be considered. No bidder shall be interested in more than one Bid. Collusion among bidders shall be cause for rejection of all such Bids without consideration. Extensions and totals submitted in the Bid will be subject to audit and verification; unit prices shall govern in event of discrepancies between unit prices and extensions or totals. Each Bid shall bear the Bidder's name, exact post office address, and the names and addresses of all persons and parties interested with him therein. Any persons signing as agents shall submit acceptable evidence of their authority. Bidders on this work, including subcontractors or vendors, will be required to comply with the Kansas Act Against Discrimination (K.S.A. 44-1001 et. seq.) and the Kansas Age Discrimination in Employment Act (K.S.A. 44-1111 et. seq.). The BIDDER agrees to abide by the requirements under Executive Order No. 11246, as amended, including specifically the provisions of the equal opportunity clause set forth in the SUPPLEMENTARY CONDITIONS, if any The Bidder shall observe the provisions of the Kansas act against discrimination and shall not discriminate against any person in the performance of work under the present contract because of race, religion, color, sex, disability, national origin or ancestry; In all solicitations or advertisements for employees, the contractor shall include the phrase, "equal opportunity employer," or a similar phrase to be approved by the commission; If the Bidder fails to comply with the manner in which the bidder reports to the commission in accordance with the provisions of K.S.A. 33-1031 and amendments thereto, the contractor shall be deemed to have breached the present contract and it may be canceled, terminated or suspended, in whole or in part, by the contracting agency; If the Bidder is found guilty of a violation of the Kansas Act Against Discrimination under a decision or order of the commission which has become final, the contractor shall be deemed to have breached the present contract and it may be canceled, terminated or suspended, in whole or in part, by the contracting agency; and the Bidder shall include the provisions of subsections (a)(1) through (4) in every subcontract or purchase order so that such provisions will be binding upon such subcontractor or vendor. Bids may be modified or withdrawn by an appropriate document duly executed (in the manner that a Bid must be executed) and delivered to the place where Bids are to be submitted at any time prior to the closing time for receipt of Bids. The City of Great Bend reserves the right to reject any and all Bids, to waive any and all informalities and to negotiate contract terms with the Successful Bidder within the nonconforming, nonresponsive or conditional Bids. Discrepancies in the indicated multiplication of unit prices and quantities shall be resolved in favor of the correct multiplication based on the unit prices indicated. Discrepancies between the indicated sum of any column of figures and the correct sum thereof will be resolved in favor of the correct sum. Upon award of the Contract, the Contractor shall order all materials required, arrange for their orderly delivery and prepare for their handling and storage upon delivery at the site; shall schedule the mobilization of construction equipment and working crews; and, shall make all such additional preparations as required for the vigorous and orderly prosecution of the Work to completion as rapidly as possible. If said Work is not prosecuted with due diligence, the Contractor may be terminated by the Owner as set forth in the General Conditions. The General Conditions, as may be modified by the Supplementary Conditions, sets forth The City of Great Bend's requirements as to the required Bonds and insurance. When the successful Bidder delivers the executed Agreement to The City of Great Bend, it shall be accompanied by the required Contract Security. Attorneys-in-fact who sign BID BONDS, performance BONDS, payment BONDS and statutory BONDS must file with each BOND a certified and effective dated copy of their power of attorney. Material and equipment incorporated into this Project are exempt from payment of the State of Kansas sales tax.. The Owner will provide the Contractor with a proper exemption certificate number within twenty (20) days after the Contract date. The Contractor is not authorized, implied or otherwise, to order any materials before the proper exemption certificate number is issued by the Department of Revenue, State of Kansas. If the Contractor becomes liable for any sales tax hereunder, the Owner assumes no liability therefore. Upon issuance of a proper exemption certificate number to the Contractor, he shall assume full responsibility for his own proper use of the number and shall pay all costs of any legally assessed penalties relating to his improper use of the exemption certificate number. Upon completion of the Project, the Contractor shall submit a "Sales Tax Exemption Project Completion Certificate" upon a form provided by the Engineer. Such Certificate must be filed with the City Engineer in conjunction with submitting the Final Estimate for Payment. Final Estimates shall not be paid until such Certificate has been completed and filed as proven herein.
