Bids received more than ninety-six (96) hours, excluding Saturdays, Sundays, and holidays, before the time set for opening of bids, as well as bids received after the final time set for receipt of bids, will not be considered and will be returned unopened. No Bidder may withdraw a bid within 90 days after the actual date of opening thereof. This project is subject to the following requirements as referenced in the Special Provisions: Buy American Preference (Reference 49 USC 50101) Foreign Trade Restrictions Davis Bacon (Reference: 2 CFR 200 Appendix 11(D)) Affirmative Action (Reference: 41 CFR part 60-4. Executive Order 11246) Govemmentwide Debarment and Suspension (Reference: 2 CFR part 180 (Subpart C), 2 CFR part 1200, DOT Order 4200.5 DOT Suspension & Debarment Procedures & Ineligibility) Government Requirements for Drug-free Workplace Nonsegregated Facilities Requirement (Reference: 41 CFR 60-1.8) The Sponsor, in accordance with the Provisions of Title VI of Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. It is the policy of the Department of Transportation (DOT) that disadvantaged business enterprises as defined in 49 CFR Part 26 shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds. All bidders and proposers shall make good faith efforts, as defined in Appendix A of49 CFR Part 26, Regulations of the Office of the Secretary of Transportation, to subcontract 6.50 percent of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals (DBE). In the event that the bidder for this solicitation qualifies as a DBE, the contract goal shall be deemed to have been met. Individuals who are rebuttably presumed to be socially and economically disadvantaged included women, Blacks, Hispanics, Native Americans, Asian-Pacific Americans and Asian-Indian Americans. The apparent successful bidder (proposer) will be required to submit information concerning the DBE's that will participate in this contract. The information will include the name and address for each DBE, a description of the work to be performed by each named firm, and the dollar value of the contract (subcontract). If the bidder fails to achieve that contract goal as stated herein, it will be required to provide documentation demonstrating that it made good faith efforts in attempting to do so. A bid that fails to meet these requirements will be considered non-responsive. For contracts of $50,000 or more, a contractor having 50 or more employees, and his subcontractors having 50 or more employees and who may be awarded a subcontract of $50,000 or more, will be required to maintain an affirmative action program within 120 days of his commencement of the contract. A Business Relationships Affidavit, Non-Collusion Affidavit, and a cashier's check, a certified check, or a surety bid bond, in the amount of five percent (5%) of the gross amount of bid as a guaranty, shall accompany the sealed proposal of each bidder. Deposits will be returned to the unsuccessful bidders and to successful bidders upon approval of the contract and submission of a 100% Performance Bond, a 100% Statutory Bond, and a 100% Maintenance Bond. On all bids below the amount of $50,000.00, the City of Enid reserves the right to waive any or all bond requirements. Doc note: Plans, Specifications, and bidding documents may also be purchased at a cost ofS25.00 by applying to the Engineer of the City of Enid at the City Administration Building. This is not a refundable deposit. Plans available for purchase will be printed halfsize (1 l"xl7" paper).
