The Project has a Design-Build budget of $5,500,000 and will include providing design and construction services for the new Meacham Airport Field Maintenance Facility located at 201 American Concourse in Fort Worth, Texas 76106. If, upon being opened, a submission is unreadable to the degree that material conformance to the requirements of the procurement specifications cannot be ascertained, such submission will be rejected without liability to the City, unless such bidder provides clear and convincing evidence (a) of the content of the submission as originally submitted and (b) that the unreadable condition of the Electronic Bid was caused solely by error or malfunction of the Bonfire Platform or its Procurement Portal. Failure to scan a clear or readable copy of a bid into the system does not constitute and shall not be considered an error or malfunction of the Bonfire Platform's Procurement Portal. Respondents are encouraged to fully review each page of every document of their submission package prior to final submittal thereof to ensure all documents are clear, legible, and complete. The City will conduct a two-step process to select the Design-Build Team that provides the best value to the City for this Project: o Step 1 - Request for Qualifications: Design-Build Teams shall submit their Statement of Qualifications as detailed in the Instructions. The City will review submitted Statements of Qualifications and create a short list of up to 3 Design-Build Teams to be invited to participate in the second step. o Step 2 - Request for Proposals: short-listed Design-Build Teams will be invited to submit proposals which shall include a completed "Design Build Proposal Form" associated with costs and fees, meet Business Equity (MWBE) requirements and to participate in team interviews, if held. The Proposals phase will rank the invited firms and contract negotiations will commence thereafter. The successful Proposer will be required to provide payment and performance bonds in a sum equal to the amount of the GMP or construction budget, to be determined during contract negotiations. Payment and Performance Bonds are not required for the design phase; however, a letter or other statement acceptable to the City indicating that the Design Build Team can provide the required bonds prior to a notice to proceed with construction is required at the time the contract is executed. The form of the bonds shall be as herein provided and the surety shall be acceptable to the City. All bonds furnished hereunder shall meet the requirements of Texas Government Code Section 2253, as amended. In order for a surety to be acceptable to the City, the surety must (1) hold a certificate of authority from the United States Secretary of the Treasury to qualify as a surety on obligations permitted or required under federal law; or (2) have obtained reinsurance for any liability in excess of $100,000 from a reinsurer that is authorized and admitted as a reinsurer in the State of Texas and is the holder of a certificate of authority from the United States Secretary of the Treasury to qualify as a surety on obligations permitted or required under federal law. Satisfactory proof of any such reinsurance shall be provided to the City upon request. The City, in its sole discretion, will determine the adequacy of the proof required herein. No surety will be accepted by the City that is at the time in default or delinquent on any bonds or which are interested in any litigation against the City. Should any surety on the contract be determined unsatisfactory at any time by the City, notice will be given to the Proposer to that effect and the Proposer shall immediately provide a new surety satisfactory to the City. At the appropriate time, for contracts in excess of $25,000, a Payment Bond shall be executed in the amount of the construction GMP for the protection of all claimants supplying labor and materials in the prosecution of the work. If the contract amount is in excess of $100,000, a Performance Bond shall be provided in the amount of the construction GMP to ensure the faithful performance of the work in accordance with the plans, specification, and contract documents; said bond shall be solely for the protection of the City of Fort Worth.
