Renovation of a transportation facility in Shakopee, Minnesota. Completed plans call for the renovation of a transportation facility.

Introduction: Scott County ("County") is seeking a Construction Manager at Risk (CMAR) to provide preconstruction and construction management services for renovations to the Marschall Road Transit Station (MRTS) building for an approximately 17,500 square feet space to house behavioral health and day treatment clinical services. The selected CMAR will need to coordinate their services and work with County staff, County's selected architectural firm for the Project, EAPC, and potential partner tenants including Allina Health during both the preconstruction and construction phases of the Project. Pursuant to Minnesota Statutes 471.463, the County is soliciting the submittal of qualifications and proposals from firms who provide CMAR services and have a proven track record of performing as a CMAR on projects similar to the Project. The Request for Qualifications (RFQ) and Request for Proposal (RFP) intends to solicit responses from prospective CMARs to act as the CMAR for the Project. The County must receive qualifications from at least two CMAR respondents to move forward with requests for proposals. Responses to this RFQ and RFP will be reviewed and will be ranked by the County's selection committee. Project Overview: The Project includes planning, design, and construct for the conversion of an existing bus garage into a multi-tenant, multi-story, clinical building to accommodate partner providers in the market. The identified building is currently under County control and represents a portion of the Marschall Road Transit Station, which is located at 1615 Weston Court, Shakopee, Minnesota. The project size is approximately 17,500 square feet across two stories with the option for a third story with approximately 7,800 additional square feet. Exhibit A contains selected preliminary project information. The County has $7,400,000 in ARPA funds budgeted for this project. Allina also received $1,000,000 in Congressionally Directed Spending funds to support the project. It is anticipated that additional funding will come from potential partner tenants as necessary. The budget includes estimates for construction costs, contingencies, miscellaneous fees, design fees, construction management fees, owner costs, FF&E, and any other typical costs related to large capital projects. Scope of Services: Scott County expects that respondents will offer a team that represents its highest level of organization, skilled personnel, and management to perform the services required. Scott County intends to use a Construction Manager at Risk construction delivery method where the basis of payment is the cost of the work plus a fee with a guaranteed maximum price ("GMP"). The CMAR will provide pre-construction services including cost estimating, construction scheduling, and developing strategy with Scott County, Allina Health, EAPC Architects Engineers, and potential partner tenants. The CMAR shall supply all labor, services, supplies, materials, and equipment to complete the work using the CMAR's best efforts, skill, judgment, and abilities. All work and services shall be conducted in compliance with Minnesota Statute 471.463 and all other applicable federal, state, and local laws, regulations, and codes. The CMAR's scope of services may change during the Project at the need and direction of the County. The County requires a Project Team that can provide holistic pre-construction and construction services from engagement to completion, in consultation with the County and EAPC, including but not limited to the following: Pre-construction Services: A. Create a baseline construction budget immediately upon engagement with Notice to Proceed B. Critical path construction schedule with long-lead and critical path items C. Budget and scope alignment tracking throughout accelerated design phase D. Lead and work with the project team to align the design scope and construction budget, with the goal of eliminating the need for valueengineering decisions E. Recommend alternative systems and materials that maximize budget savings and minimize the project schedule duration F. Provide constructability reviews and provide recommended alternative methods as necessary G. Attend design and pre-construction meetings as needed H. Code Review Participation Construction Phase Services: A. Attend and lead all construction meetings B. Preparation and distribution of meeting agendas, minutes, and action items C. Furniture, Fixtures, and Equipment systems installation coordination D. Technology systems installation coordination (tele/data, security, A/V, noise cancellation, etc.) (technology design and procurement by others) E. Obtain necessary permits F. Procure and manage subcontracted work G. Provide periodic executive project status updates Respondent Requirements : CMAR respondents shall comply with the following requirements to be considered for selection. Qualifications and Proposals submitted by respondents failing to meet these requirements shall be considered nonresponsive. A. The respondent shall be licensed in the State of Minnesota. B. Responder is required to ensure that any and all licenses as required by state and federal statutes are maintained during the term of the contract. C. It is the responsibility of the Responder to comply and be current with all current laws of the State of Minnesota. D. The respondent shall have experience constructing public buildings, recreation facilities, parks, pools, etc. E. All employees of the Responder shall be experienced and competent technical persons with experience and qualifications in completing similar projects and shall be directly employed and supervised by the Responder. F. The respondent shall be capable of meeting the Project milestones. G. The respondent shall agree to Open Book accounting for all costs for the Project. H. The respondents shall agree to self-perform only work that they have competitively bid. The respondents will need to get the County's approval to submit its own bid for any of the trade work necessary for the Project. In such case, the County alone will review the bids and make the selection decision for that trade work. I. The respondent meets the minimum criteria specified in Minnesota Statutes 16C.285. Insurance Requirements A. Workers' Compensation: 1) State: Minnesota - Statutory 2) Employer's Liability with minimum limits of: Bodily Injury by Accident: $100,000 each Accident Bodily Injury by Disease: $100,000 each Employee Bodily Injury by Disease: $500,000 policy limit 3) Benefits required by union labor contracts: as applicable B. Commercial General Liability: Including Premises, Operations, Products, Completed Operations, Advertising, and Personal Injury Liability, with the following minimum limits of liability: $2,000,000 Aggregate $2,000,000 Products & Completed Operations Aggregate $1,000,000 Personal Injury & Advertising Injury $1,000,000 Occurrence $100,000 Fire Damage Limit $5,000 Medical Expense Policy should be written on an occurrence basis and include explosion, collapse and underground. C. Commercial Auto Liability: Automobile Liability should include Hired and Non-Owned, and the County should be named as an additional insured. Minimum limits of liability shall be: If split limits: $1,000,000 each person/$1,000,000 each occurrence for Bodily Injury $1,000,000 each occurrence for Property Damage If combined single limit: D. Proof of Insurance: $1,000,000 per occurrence Insurance certificates evidencing that the above insurance is in force with companies acceptable to County and in the amounts required shall be submitted to County for examination and approval prior to the execution of the agreement, after which they shall be filed with County. The insurance policy shall name the County as an additional insured and specifically provide that a policy shall not be materially changed, canceled or non-renewed except upon sixty (60) days prior written notice to County. Neither County's failure to require or insist upon certificates, nor other evidence of a variance from the specified coverage requirements, amends Respondent's responsibility to comply with the insurance specifications. Bond Requirements : Bonds are required for all contracts of $175,000 or greater in value. Payment and Performance Bonds shall be issued by a surety company meeting the County's approval with amounts shown on each equal to 100% of the total amount of the estimate cost of the Work plus estimated CMAR fee and shall also provide that omissions from or additions to the work may be made without notice to the surety company. The surety company must be listed in the federal register, latest edition.
