Each bid shall be accompanied by a cash deposit or a certified check drawn from a bank or trust company of an amount equal to not less than five percent (5%) of the bid, or in lieu therof a bidder may offer a Bid Bond of five percent (5%) of the bid executed by a surety company. Said deposit shall be retained by the owner in event of failure of the successful bidder. A Payment Bond and separate Performance Bond shall be required to execute the contract in accordance with the Project Manual The owner reserves the right to reject any or all bids and to waive informalities. The Owner has set a verifiable goal of ten percent (10%) participation by Minority Business Participation for the construction contract which is equal to that set in Franklin County. The signatories further agree for each calendar day that any part of the work remains uncompleted after the contract time stipulated for completion of the work, liquidated damages in the amount of Five Hundred Dollars ($500.00) shall be assessed for each consecutive calendar day for unauthorized delays beyond the contract date for failure to achieve Substantial Completion; Two Hundred Fifty Dollars ($250.00) for each consecutive calendar day for unauthorized delays for failure to finalize all work, clean up, exist site and to achieve Final Completion by the contract time; and One Hundred Dollars ($100.00) per day for failure to finalize Project Close Out requirements. These monies will be set aside or deducted from any monies due the Contractor or, if no money is due to the Contractor, the Owner shall have the right to recover said sum or sums from the Contractor or from the surety or from both.
