No bid may be withdrawn for at least sixty (60) days after the scheduled closing time for receipt of bids. Each proposal must be accompanied by a Bidder's Bond, or Cashier's Check upon any solvent Bank or Trust Company, payable without reserve to the Muskogee Municipal Authority, Muskogee, Oklahoma, in an amount not less than five percent (5%) of the total amount of the bid. Bid security of the two low bidders will be retained until approval of contract and execution of satisfactory bonds by the successful bidder, or until other disposition on the bids is made. The bonds required will be a Performance Bond, a Payment Bond, and a Maintenance Bond, each in the full amount of the contract. The Authority will not accept letters of credit in lieu of any bond required herein. The Owner reserves the right to waive any informalities in the bidding. Conditional bids will not be accepted. No bid may be withdrawn after the scheduled closing time for receipt of bids for at least Sixty (60) days. The bid may be extended for a period of 30 days by mutual agreement of the bidder and the Owner. The attention of all bidders is called to the fact that they must meet the requirements and bid in accordance with the laws of the State of Oklahoma governing public works contracts.
