The bid bond shall be executed by a surety company acceptable to the Town, in an amount not less than five (5%) percent of the Grand Total Bid set forth in the proposal. Bid deposits shall be in an amount not less than five (5%) percent of the Grand Total bid set forth in the proposal. All bid deposits shall be in the form of certified check, official bank check, or money order. Such deposits and bid bonds will be returned to all except the three lowest bidders within fifteen (15) days after an award is made. (a) Within seven (7) days of notification to the successful bidder of acceptance of Contractor(s)' bid proposal, the Contractor shall furnish a labor, payment, performance and maintenance bond in an amount at least equal to one hundred percent (100%) of the contract price, as security for the faithful performance of this Contract, and for the payment of all persons furnishing labor and materials in connection with this Contract. The surety on such bond shall be a duly authorized surety company satisfactory to the Owner. the Owner reserves the right to waive any deficiencies which are deemed to be minor in the sole opinion of the Town and reject any or all bid proposals, or to make an award to other than the low bidder or to advertise for new proposals, if, in the opinion of the Town Board, the best interest of the Owner will thereby be promoted.
