The Work to be done under the Contract shall consist of the remedial soil excavation of lead- impacted soil, appropriate disposal of impacted soil off-site, and site restoration activities at both Weston Memorial Community Centre Hock Rink (Weston CC) and Mission Park. The major components of the Work are as follows: (a) Mobilize and demobilize at Weston CC. (b) Excavate lead-impacted soil within the Weston CC hockey rink. (c) Transport and appropriately dispose of impacted soil from the Weston CC excavation. (d) Supply, haul, and compact clean backfill for base-course, sub-base, and subgrade in the Weston CC excavation. (e) Finish the Weston CC excavation backfill with Type II Asphalt pavement. (f) Mobilize and demobilize at Mission Park. (g) Excavate lead-impacted soil at the eastern portion of Mission Park. (h) Transport and appropriately dispose of impacted soil from Mission Park. (i) Supply, haul, and compact clean backfill in the Mission Park excavation. Award is subject to final approval. (j) Finish the Mission Park excavation backfill to existing grade with sod. a performance bond of a company registered to conduct the business of a surety in Manitoba, in the form attached to these Supplemental Conditions (Form H1: Performance Bond), in the amount of fifty percent (50%) of the Contract Price; and (b) a labour and material payment bond of a company registered to conduct the business of a surety in Manitoba, in the form attached to these Supplemental Conditions (Form H2: Labour and Material Payment Bond), in an amount equal to fifty percent (50%) of the Contract Price; or If the Contractor fails to achieve Substantial Performance or Total Performance in accordance with the Contract by the days fixed herein for same, the Contractor shall pay the City the following amounts per Working Day for each and every Working Day following the days fixed herein for same during which such failure continues: (a) Substantial Performance - Three hundred and fifty dollars ($350); (b) Total Performance - Three hundred and fifty dollars ($350). The Contractor shall achieve Substantial Performance by October 31, 2024. The Contractor shall achieve Total Performance by June 30, 2025. Further to B17.1(a), the Award Authority may reject a Bid as being non-responsive if the Bid is incomplete, obscure or conditional, or contains additions, deletions, alterations or other irregularities. The Award Authority may reject all or any part of any Bid, or waive technical requirements or minor informalities or irregularities, if the interests of the City so require.
