DHHS Painting Phase 2 The County of Colusa (COUNTY) is requesting bids (RFB) from licensed contractors for interior painting located at the Health and Human Services building, 251 E. Webster Street, Colusa, CA as more specifically detailed in the Scope of Work with in this RFB. This is a public works contract subject to Department of Industrial Relations registration and payment of prevailing wage. TERMS AND CONDITIONS: 1. Department of Industrial Relations Registration: All contractors and subcontractors shall register with the California Department of Industrial Relations (DIR) pursuant to California Labor Code sections 1771.1 and 1725.5 prior to bidding on the Project. The County will not consider bids from bidders who have not registered in compliance with the law. 2. Prevailing Wage: This Project is subject to prevailing wage rates. Copies of the prevailing rates or per diem wages applicable to this Project are available from the California Department of Labor Statistics and Research at www.dir.ca.gov/dlsr/PWD/index.htm or 455 Golden Gate Avenue, 9th Floor, San Francisco, California 94102 (415) 703-4780. A successful bidder awarded a contract ("Contractor") will be required to post a copy of the wage rates on the job site. Any employee whose type of work is not covered by any of the classified wage rates shall be paid not less than the rate of wage listed for the classification which most nearly corresponds to the type of work to be performed. Pursuant to California Labor Code section 1775, the Contractor, and any subcontractor, shall forfeit up to $200.00 per calendar day, or portion of a day, for each worker paid less than the prevailing rates for such work or craft, and the penalty shall be imposed and distributed pursuant to Section 1775. 3. Payroll Records: A contractor and any subcontractors will be required to keep accurate payroll records pursuant to California Labor Code section 1776(a). The records shall be furnished at least once a month to the California Labor Commission pursuant to California Labor Code section 1771.4(a)(3). 4. Description of Request: Interior painting of the Health and Human Services building located at 251 E. Webster Street, Colusa, CA, as more specifically detailed on the Scope of Work below. 5. Types of Bids Required: A. Lump-sum bids shall be provided, per the specification sheet included with this request for bids. B. Conditional Bids shall not be considered 6. Time of Completion: The work is to be completed within sixty (60) calendar days, measured from the date of Board of Supervisors approval of the contract. Once work is commenced, it must be completed within 14 calendar days. A responsive bid must include a fully completed Bid Worksheet. Bidders may use the provided Bid Worksheet or submit their own bid worksheet and additional information sheets, as needed. If a bidder uses its own worksheet, the worksheet must substantially comply with the format in the attached Bid Worksheet. All bids (exceeding $25,000.) shall be presented under sealed cover and shall be accompanied by a security bond in the amount of ten (10) percent of the bid amount to guarantee the bid. Upon award to the lowest bidder, the security of unsuccessful bidders shall be returned no later than sixty (60) days from the date the contract is awarded. The County will accept the following forms of security: 1) Cash; 2) A cashier's check made payable to the County; 3) A certified check made payable to the County; or 4) A bidder's bond executed by an admitted surety insurer, made payable to the County. Any questions regarding this RFB can be submitted to the Public Purchase Website until 2:00 p.m. September 30, 2024: Any addenda issued shall be included in the bid proposal. All information shall be typewritten or entered in ink. Mistakes may be crossed out and corrections inserted before submission of your Bid. Corrections shall be initialed in ink by the person signing the Bid. Corrections and/or modifications received after the closing time specified will not be accepted. Bids must be submitted by the closing date or prior to the time specified to be considered. Any Bid tendered after the time specified will be returned to the Vendor. Bid pricing shall remain open and valid subject to acceptance for ninety (90) days after RFB closing date. Bid Prices by Vendor are considered accurate and cannot be withdrawn after the RFB process is closed. Upon submission of Bid, all such documents shall become the property of the County. The County reserves the right to reject any and all bids. The successful vendor shall be required to enter into a contract with the County of Colusa for the services to be provided. Such contract shall incorporate the specifications of the RFB. (A draft copy is attached) Any Change Orders or issues that may arise must be discussed with the Maintenance Supervisor for prior approval of the best course of action. Quantity and Quality of Materials or Services: All materials and supplies furnished for this Project must comply with County specifications. Materials or supplies, which, in the opinion of the County, are not in accordance with in conformity with such specifications, shall be rejected and promptly removed from the County premises at the vendor's expense. Award: The Project shall be awarded to the lowest responsible bidder in accordance with California Public Contract Code section 20128. Each Bid shall follow the format specified by the County. Any bid not complying with the County format shall be considered nonresponsive. Withdrawing Bids: No Vendor may withdraw his bid for a period of ninety (90) days after the date and time set for the opening thereof, and no bid security shall be released prior to said date; provided, however, that the County may release the Bid and Bid security of unsuccessful vendors after confirming the technical and formal sufficiency of the Bid and Bid security of the three (3) lowest vendors. In no event shall the Bid for security of the three (3) lowest vendors be released before execution with the County of Colusa of an Agreement with the successful vendor, or the expiration of ninety (90) days, whichever occurs first. Rejection of Bids: The County of Colusa reserves all rights to utilize any alternate procedure authorized by the Public Contract Code Sections 20150.9 and 20150.10, including but not limited to rejecting all bids and/or to waive any informality in the RFB process. Default by Vendor: In case of default by vendor, the County reserves the right to: Cancel the order and obtain the service on the open market, in which case, Vendor shall be responsible to County for the difference between the Bid price and the purchase price if the purchase is higher; and/or Assess a reasonable per day charge against the vendor for inconvenience or damages incurred by County as a result of delayed delivery, except when delivery is delayed by fire, strike, freight embargo, act of Government, or an act of God. The rights and remedies of the County provided above shall not be exclusive and are in addition to any other rights and remedies provided by law or under the contract. Non-Funding Clause: Funds provided for commodities or services under the terms of an agreement, contract or Bid are contingent on availability of funds. Should sufficient funds not be allocated during those terms, amounts due may be modified or terminated at any time by the County upon thirty (30) day notice. Notice shall be fully given in writing or through service in person or by first class mail. Detailed specifications are attached, marked "Project Specifications". These minimum specifications are not intended to be restrictive, but descriptive of the type and quality of product the County desires to obtain. Vendors will not be allowed to make unauthorized substitutions. Bid Sheet is attached, marked "Bid Worksheet". Point of Sale is Colusa, CA
