Box 999 Richland, WA 99352 USA Tel: 509-375-3616 paula.miller@pnnl.gov Location:Houston, TX and Freeport, TX Country:United States Introduction/Background Battelle Memorial Institute, Pacific Northwest Division (Battelle) operates the Pacific Northwest National Laboratory (PNNL) for the U.S. Department of Energy and is authorized to issue this Request for Proposal (RFP). Throughout this document, the term "Contract" is used to refer to any resultant Battelle Contract. Captions are included in this document and Battelle's General Provisions for convenience of reference only and in no other way define or delineate any of the provisions hereof or otherwise affect their construction or effect. Under no circumstances shall the recipient of this RFP contact any individual within Battelle (excluding contact with Battelle's Ombudsman [see RFP Additional Instructions/Information for Offeror section below]), other than the Contracts Specialist named above regarding this RFP. SCOPE OVERVIEW Scope: This RFP is for Booth Replacement at Barbours Cut, Freeport, Greensport and Turning Basin, Houston, TX as described in the Division 1 (DIV-1). DRAFT Contract: Offeror shall thoroughly review the attached DRAFT Contract and propose accordingly. It includes applicable language related to Scope, Environment, Safety, and Health Requirements and the role of the TOR as well as other applicable language. The DRAFT Contract is provided for preliminary review purposes and is an example of what the final Contract will include. The content of the DRAFT Contract is subject to change prior to execution of the final Contract. NAICS: NAICS is the abbreviation for "North American Industry Classification System." NAICS was developed by the U.S., Canada, and Mexico in a joint effort to provide new comparability in statistics about business activity across North America. NAICS assigns codes to all economic activity within twenty broad sectors and is accepted and used by the Small Business Association (SBA) in determining size standards where eligibility as a small business is a factor or a consideration. The NAICS Code for this service is 236220 - Commercial and Institutional Building Construction. The stated size standard is $45.0M. The stated size shall be the sole determining factor as to classification (small or large business) of an Offeror. It is the responsibility of the Offeror to certify its size on the attached Representations and Certifications in their proposal. BASIS OF AWARD Contract Award (cl 600 revised - July 2020) Battelle may evaluate proposals received in response to this RFP without discussion (initial proposal should contain the Offeror's best price and technical terms). Selection Method: Contract award, if any, will be made to the responsive and responsible Offeror whose evaluated proposal provides for the lowest price after satisfying all the technical requirements of this RFP. Rights Reserved: Battelle may: A. reject any or all proposals; B. request clarification of minor irregularities, informalities or apparent clerical mistakes; C. waive minor irregularities, informalities or apparent clerical mistakes in offers received; D. accept any item or combination of items, unless doing so is precluded by a restrictive limitation in the RFP or the proposal; E. award multiple contracts as a result of this RFP; F. reject a proposal as non-responsive if the prices proposed are materially unbalanced between line items or sub-line items. A proposal is materially unbalanced when it is based on prices significantly less than prices for some items and prices which are significantly overstated in relation to prices for other items, and if there is a reasonable doubt that the proposal will result in the lowest overall price to Battelle even though it may be the lowest evaluated proposal, or if it is so unbalanced as to be tantamount to allowing an advance payment; G. conduct site visits to the home or field offices of Offeror (Offeror will be notified with the date and time of arrival, an outline of the duration of the visit, and any assistance/information required); H. require oral presentations from any or all Offerors, determined to be in the competitive range (Offerors will be notified of the time and place for such presentation); I. request oral and/or written discussions; J. determine a competitive range, including all proposals that are judged to have a reasonable chance of being selected for award, and negotiate with all Offerors within it. (In the event a competitive range is determined, it will be based solely on Battelle's judgment, and Best and Final Offers will be requested at the conclusion of negotiations); K. negotiate only with a single Offeror to further reduce the price paid if, in the judgment of Battelle after a review of the technical and price offers, only one Offeror has a reasonable chance of being selected for award. L. conduct a cost or price audit to facilitate a determination of price reasonableness; or M. re-solicit this requirement. PROPOSAL SUBMITTAL REQUIREMENTS General: Proposals should be prepared simply and economically, and provide a straightforward, concise delineation of the information required to be furnished. Emphasis should be on completeness and clarity. Elaborate brochures or other presentations are neither required nor desired. Offerors that fail to provide ALL items and quantities specified in this RFP may be deemed non-responsive in their entirety and may not be considered for award.2 o Advance Notice: Email notification must be sent to the Contracts Specialist at least 3 business days prior to the Job Walk with list of attendees o ID/Badge: Official Government issued Photo ID, TWIC Card, Site Specific Badge (Note: If any attendees do not have a TWIC Card/Site Specific Badge, please inform the Contracts Specialist when submitting list of attendees) o PPE: Hi-Vis Vest, substantial footwear NOTE: Any questions asked during the Job Walk should be submitted, in writing, to the Contracts Specialist. Responses to all pertinent questions as well as any resulting changes, will be incorporated into the RFP via written Amendment and furnished to all Offerors by the Contracts Specialist. Proposal shall include: o Price Proposal: o Completed and signed signature page of this RFP indicating acceptance of the scope, terms and conditions, and General Provisions identified in this RFP and the attached DRAFT Contract. o Completion of the attached Construction Pricing Form(s (Attachments O, P, Q and R). Offer shall be in terms of U.S. dollars. Offers received in other than U.S. dollars shall be rejected. All pricing must be firm for the duration of this Contract. The quoted price(s) must include all costs for materials, labor, equipment, testing; and any and all items of expense, fees, taxes, duties, overhead and profit for full and complete performance of the work. The FirmFixed-Price shall be the "Firm-Fixed-Price Proposal" as shown on Page 1 of this RFP. Furthermore, the Offeror's signature acknowledges that the Offeror has understood and the "Firm-Fixed-Price Proposal" complies with performance percentages as defined in Clause 10 titled "Limitations on Subcontracting" in the General Provisions. o Technical Proposal: o Cover letter signed by an authorized representative of the Offeror and submitted as part of the proposal as a separate electronic .pdf file. o Evidence that EMR is less than or equal to 1.0 for Prime Contractor on a 3-year rolling average. Supporting documentation shall be provided. Supporting documentation shall be provided. If the Prime Contractor and any Lower-Tier Subcontractors have an EMR greater than 1.0, than the contractor shall provide the following: o Occupational Safety and Health Administration (OSHA) Days Away Restricted or Transferred (DART) Rate and OSHA Total Recordable Incident Rate for each of the most recent three years for which data is available. o Explanation of (a) the circumstances leading to the excessive rate, (b) steps taken to address the excessive rate, (c) the effectiveness of the steps taken, and (d) any proposed compensatory measures that will be implemented to ensure compliance with Battelle's overall Environmental Safety and Health (ES&H) goals and objectives. o Battelle will evaluate and asses the responses and documentation provided to determine whether the Contractor and/or Lower-Tier Subcontractor is accepted to perform construction activities in support of Battelle. Additionally, Battelle has the discretion to deem the Contractor and/or Lower-Tier Subcontractor safety performance unacceptable and can require the Contractor to submit a written Safety Improvement and Sustainability Plan. o Letter of acknowledgment that the Prime Contractor and potential Subcontractors have a Quality Assurance and Environmental Safety and Health Plan. Offeror also to acknowledge intent to follow applicable information security provisions (e.g., FOUO material) and applicable U.S. Export Control Regulations. Letter shall be signed by an authorized representative. o Project Execution Plan to meet the Schedule that includes the following elements: o Staff/crew labor mix matrix in MS Excel or equivalent format o Equipment utilization plan - identify equipment type (make/model), associated scope and required duration o Qualifications/Experience Summary which includes: o Evidence of Prime Contractor's or Subcontractor's proven track record as having successfully completed similar projects and performed comparable work within the last five years. At least two examples shall be provided which include project description summary, location and size, etc. o On-site Foreman/Construction Manager - Provide Resume that, at a minimum, includes relevant experience and applicable certifications for key personnel who will be responsible for onsite activities o Subcontractors - provide list of all potential subcontractors and identify their associated scope o Certifications/qualification - provide applicable certifications and qualifications for planned staff/subcontractors o List of Exceptions - Any items not included in the proposed price and/or planned material substitutions. o Other Submittals: o Completed attached Representations and Certifications (Attachment J). o Permits and Licenses for the local jurisdiction (if applicable) are required from the Offeror. If the Offeror possesses a current license for the States in which the work is to be performed, the Offeror shall submit the Certificate of License number; which grants them the authority to work as a Contractor in the State, County and/or Municipality where the work is to be performed. If Offeror does not have such license or certificate, a copy of the application for it must be submitted with an estimate of time required to obtain it. If said license is not required by the State, County, and/or Municipality where the work is to be performed, the Offeror shall provide documentation, in the form of a signed letter, stating that, based on licensing requirements by the State, County, and/or Municipality, (a) such licensing is not required and (b) the General Construction Contractor and Subcontractors possess appropriate authority to work where the work is to be performed. As applicable, the documentation shall cite the official State, County, and/or Municipality reference for said authority. o Bid Bond (see Additional Instructions/Information For Offeror section below for more information). Questions: Should Offeror have questions on the RFP, they must be presented to the Contracts Specialist, in writing, by the Questions Due Date and Time above. Questions received late may not be answered. If applicable, the Questions should reference specific scope details. The Questions and Battelle's Answers will be transmitted in writing to all Offerors. Additionally, any Offeror desiring an explanation or interpretation of the RFP, drawings, specifications, etc., must request it in writing by the Questions Due Date and Time specified. Oral explanations or instructions given before the award of a contract will not be binding. Any information given an Offeror concerning an RFP will be furnished promptly to all other Offerors as an amendment to the RFP, if that information is necessary in submitting proposals or if the lack of it would be prejudicial to other Offerors. Intent to Propose: Offeror shall complete the Notification of Intent (to Submit Proposal) by the Intent to Propose Due Date and Time. False Statements in Proposals: Offerors must provide full, accurate, and complete information as required by this RFP and its attachments. The penalty for making false statements in proposals is prescribed in 18 U.S.C. 1001.
