All bids will be received electronically via Public Purchase website. Contractor accepts responsibility for delivery method. Late quotes will not be accepted. INSTRUCTIONS TO BIDDERS AND GENERAL INFORMATION 1. QUOTE FORM: All Quotes shall be submitted on the Quote Proposal Form enclosed herein. Bidder provided quote forms shall not be accepted This means do not include your normal quote sheet as it may have terms and conditions that conflict with this quote rendering your quote non-responsive. 2. REJECTION OF QUOTES: The City of Richland (City) reserves the right to reject any and all quotes and to waive irregularities and informalities in the bidding process. No quote may be withdrawn until sixty (60) days after the date and time set for the opening thereof. 3. NOTICE TO PROCEED: Contractor shall not begin work until the City provides a Notice to Proceed. 4. PRE-BID OPTIONAL SITE-MEETING: A non-mandatory pre-bid site-meeting will be at GBD Storage 3050 Queensgate Dr, Richland, WA 99352, on September 26, 2024 at 10:00 AM. Bidders are strongly encouraged to attend. 5. TIME OF COMPLETION: Work under this contract shall begin with Notice to Proceed from the City. Work shall be completed within 15 working days. 6. INSURANCE: Insurance will be required as shown in Attachment B. 7. BONDS & RETAINAGE: No Bid Bond is required. Payment and Performance Bond is required. Retainage is required. 8. PERMITTING: City will be responsible for obtain the required permits. 9. PREVAILING WAGES & BENEFIT CODE KEY: Per the requirements of Chapter 39.12 RCW, this project is subject to prevailing wages. The State of Washington prevailing wage rates applicable for this public works project, which is located in Benton County, may be found at the following website address of the Department of Labor and Industries: https://lni.wa.gov/licensing-permits/public-works-projects/prevailing-wage-rates/. A copy of the applicable prevailing wage rates are available for viewing at the City of Richland's Purchasing Division office, located at 2700 Duportail Street, Richland, WA 99352. Upon request, the City will mail a hard copy of the applicable prevailing wages for this project. The prevailing wage rates in effect on the bid opening date are the prevailing wage rates that apply to this project; no matter how long it lasts, unless the contract is awarded more than six months after the bids were due. For those contracts where award was delayed more than six months, the prevailing wage rate in effect on the date of the award shall apply for the duration of the contract. 10. BUSINESS LICENSE REQUIRED: The Contractor awarded this contract is required to obtain a City of Richland business license. Every business operating in the City of Richland must be registered with the city and state. This includes businesses located in the City limits of Richland and those coming into Richland to do business. The fee for a Richland business license is $40, which includes the fee cost for two full-time equivalent workers (whether owners or employees), plus $12 for each additional full-time equivalent employee. WORKING HOURS: Working hours shall be limited to comply with Richland City Code: Chap. 9.16 - Public Nuisance Noise - Prohibited, construction and related activities shall be limited to between the hours of 9:00 pm and 7:00 am. Other time restrictions may apply to in-street activities during peak hours. Variations will be considered on a case by case basis and must be approved in advance by the Project Manager. a. Contractor must be registered with PublicPurchase.com. Visit the City of Richland website at: Richland, WA - Public Purchase Website for instructions to register. b. Register as early as possible and do not wait until the due date as the registration process may take up to 24 hours to complete. c. Public Purchase staff is available Monday - Friday, 8 am to 5 pm Central Time. d. Electronic submittals shall be limited to the documents specified in this document. e. The City of Richland cannot guarantee internet access. It is strongly recommended that you respond 24 hours prior to the bid closing and time for submittal. f. The City is unable to verify if a proposal has been successfully uploaded in Public Purchase. The Public Purchase system places all proposal submissions into a virtual lock box where they cannot be viewed by the City until after the due date and time. g. Contractors can check their submission by returning to the home page of Public Purchase. The Proposal will be shown in the "Bids Responding To" section. DO NOT EMAIL A COPY OF YOUR BID TO THE CITY. h. The Public Purchase website will not allow proposals to be uploaded after the due date and time established. Contractors accept all risks for uploading their submittal by the established due date and time. i. If a Contractor uploads a file to Public Purchase, it is the Contractor's responsibility to ensure the file is not corrupt or damaged. If the City is unable to open an attachment because it is damaged, corrupt, infected, etc., the City may disqualify the Contractor's submission. SCREENING & SECURITY: If noted in the scope of work, certain areas within the City of Richland facilities such as the Data Centers, Police Operations, Utility reservoirs and Pump Stations all have some level of security required. Because of these security needs, Contractors may be required to pass a background check and be issued a City identification badge before they can start work. Background checks may include fingerprinting. Failure to submit to, and/or have enough staff qualified to do the work pass this background check, may result in the Contractor being considered "Non Responsive". NEW OR USED: All equipment utilized shall be of new manufacture, unless otherwise specifically stated or called for in the Quote Documents. INCURRED COSTS: The City of Richland is not liable in any way for any costs incurred by bidders in replying to this quote request. MOBILIZATION: Mobilization, Traffic Control, Property Restoration, disposal, and all other incidental charges shall be included in the Invitation to Quote Form. WAC RULE 458-20-171 (when applicable): Building, repairing or improving streets, roads, etc., which are owned by the City of Richland and which are used primarily for foot or vehicular traffic. According to WAC 458- 20-171 (Rule 171) the City of Richland assumes that construction, repair and maintenance of roads, walkways, and bike paths located in a city-owned park are considered public road construction and therefore, not subject to retail sales tax. This includes all related maintenance services, lighting, signage, fencing, irrigation, handrails and landscaping. OFFICIAL SIGNATURES: Quotes shall be signed by one of the legally authorized officers of said corporation. If awarded the contract, the Contract shall also be so executed. If a Quote or Contract is signed by an agent, the agent shall provide satisfactory evidence of authority to sign as legal representative of Bidder, upon request of Richland. An authorized partner of a co-partnership may sign the contract, subject to the approval of the attorney, who may at his discretion, require each and every member of the co-partnership to sign the contract. MANDATORY BIDDER RESPONSIBILITY CRITERIA: As required by RCW 39.04.350, as amended, before award of a public works contract, a bidder must meet the following responsibility criteria to be considered a responsible bidder and qualified to be awarded a public works project. The bidder must: A. At the time of bid submittal, have a certificate of registration in compliance with chapter 18.27 RCW; B. Have a current state of Washington unified business identifier number (UBI); C. If applicable, have 1. industrial insurance coverage for bidder's employees working in Washington State as required in Title 51 RCW; 2. an employment security department number as required in Title 50 RCW; 3. and a state excise tax registration number as required in Title 82 RCW D. Not be disqualified from bidding on any public works contract under RCW 39.06.010 or 39.12.065(3) ), or be suspended or debarred from working on a federally funded project according to the federal website. E. Not be in violation relating to Wage Payments as defined in RCW 49.48.082 or any provision of Chapters 49.46 or 49.52. F. Effective July 1, 2019: In accordance with the revised responsible bidder criteria in RCW 39.04.350, all businesses are required to have training before contract award on public works projects. Note: this applies to all public works projects that start on or after July 1, 2019. SUBCONTRACTOR RESPONSIBILITY: At the time of the execution of any subcontract, the Contractor shall verify that each of its first tier subcontractors meets the following bidder responsibility criteria by requiring each subcontractor to: A. Provide a current certificate of registration in compliance with chapter 18.27 RCW, as amended, which must be in effect at the time of bid submittal; B. Provide a current Washington Unified Business Identifier (UBI) number; This is a Restrictive Bid An invitation to Bid was issued in accordance with RCW 35.22.620, which permits the use of a Small Works Roster to solicit bids. Only qualified contractors who have (1) filled out an application to be on the MRSC Small Works Roster and have been accepted, and (2) been invited to bid on this project by the City, may submit bids. If you did not receive an email invitation to this bid directly from the City of Richland, you are not eligible to submit a bid response. The project consists of, but is not limited to, furnishing all materials, labor, tools and equipment necessary to perform the work required. The project includes removal and disposal of chain link fence, installation of CMU walls, vegetation/garbage removal, installation of crushed rock and other related work at 3050 Queensgate Drive, Richland, WA.
