This shall be surety for fulfillment of the contract(s) including quality, performance and delivery under the terms of this Request for Proposal. Liquidated damages shall consist of 8 % per calendar day per line item for failure to deliver according to the Contractor specified delivery schedule. Liquidated damages will be deducted from payments on the invoice covering the late service/work, if the invoice is of sufficient amount to cover the liquidated damages. If the invoice is not of a sufficient amount to cover the liquidated damages on a particular project, the agency may bill the contractor for the balance or may request cancellation of the invoice and a credit to cover the balance. All contracts with any federal funding let to bid and entered in to by the sponsor require provisions governing the employment and payment of persons hired by contractors, subcontractors, and suppliers to perform the contract work. These contract provisions are outlined in the Form FHWA-1273, Section IV. Davis-Bacon and Related Act Provisions. The sponsor is responsible for the application and monitoring of these provisions. All workers on the site of the work will be paid unconditionally and not less often than once a week without subsequent deduction or rebate on any account (except such payroll deductions as permitted by law, the full amount of wages and bona fide fringe benefits (or cash equivalents thereof) due at time of payment computed at rates not less than those contained in the federal prevailing wage determination regardless of any contractual relationship which may be alleged to exist between the contractor and such laborers and mechanics. Such laborers and mechanics will be paid the appropriate wage rate and fringe benefits on the wage determination for the classification of work actually performed, without regard to skill. Laborers or mechanics performing work in more than one classification may be compensated at the rate specified for each classification for the time actually worked. This RFP is intended to solicit proposals for environmental services including hazardous materials and asbestos investigation and remediation services, air quality compliance assistance, residential lead sample analysis, stormwater and wastewater compliance support, and environmental training services. The following is a list of example services under each category. This is not an all-inclusive list. Hazmat (hazardous materials) Phase 1 through 4 site investigations and remedial actions following the WisDOT Facilities Development manual, or similar services following the requesting agency's procedures Materials handling plans and special provisions remediation of hazardous materials during highway or other construction remediation oversight Annual compliance reporting Program management assistance Construction emergency response, including UST removal or unexpected contamination requiring waste profiling and disposal Spill Prevention, Control and Countermeasures (SPCC) plan review SPCC technical amendments Facility Response Plans (FRP) Fueling system removal Tank system site assessments Describe the organization/company's experience and capabilities providing similar services to those required. Be specific and detail no more than 3 projects/contracts for each subsection. Include a description of work, dates, locations, and results. The Department reserves the right to verify with listed firms their involvement as subcontractors or second-tier suppliers. The State of Wisconsin shall not enter into a contract with a vendor, and reserves the right to cancel any existing contract, if the vendor or Contractor has not met or complied with the requirements of s.77.66, Wis. Stats., and related statutes regarding certification for collection of sales and use tax. The agency reserves the right to reject any and all proposals. The agency reserves the right to negotiate the terms of the contract, including the award amount, with the selected proposer prior to entering into a contract. If contract negotiations cannot be concluded successfully with the highest scoring proposer, the agency may negotiate a contract with the next highest scoring proposer. A schedule of minimum prevailing wages for the county in which the work will be done is required to be included in the contract. This will be accomplished by providing the prevailing wage rate schedule with the request for work covered by the prevailing wage rates at the time of request. Issued by the United States Department of Labor (US DOL). WI 10 wages are to be inserted in every contract with federal funding (applies to all work except work over a navigable waterway). WI 15 wages are to be inserted into a contract if there is a bridge or structure located over a navigable waterway as defined by USDOL and the US Coast Guard (applies to all work occurring on the bridge/structure from bank to bank). WI 08 wages are to be inserted into a contract if it contains sewer work that is over 20% of the contract amount Any questions concerning this RFP must be submitted in writing on or before Monday, September 23, 2024 to: Sally Maier, Purchasing Agent, email: SALLY.MAIER@DOT.WI.GOV. Vendors are expected to raise any questions, exceptions, or additions they have concerning the RFP at this point in the RFP process. If a vendor discovers any significant ambiguity, error, conflict, discrepancy, omission, or other deficiency in this RFP, the vendor should notify immediately the above-named individual of such error and request modification or clarification of the RFP. January 1, 2025 (estimated) Contract start date (estimated) The purpose of this document is to provide interested parties with information to enable them to prepare and submit a proposal for environmental services including hazardous materials and asbestos investigation and remediation services, air quality compliance assistance, residential lead sample analysis, stormwater and wastewater compliance support, and environmental training services. The State as represented by its Wisconsin Department of Transportation (WisDOT), Department of Health Services, Department of Military Affairs and Department of Natural Resources intends to use the results of this Request for Proposal (RFP) to award one or more contracts for the above listed services. Separate contracts for individual services may be awarded, for example, a separate contract for residential lead sample analysis, or a separate contract for asbestos inspection and abatement. The WisDOT Purchasing Unit is the sole point of contact for the State of Wisconsin during the selection process. Friday, December 13, 2024 (estimated) Contract award (estimated) The contract shall be effective on the date indicated on the purchase order or contract and shall continue for 2 year(s) from that date. By mutual agreement of the agency and the contractor, the contract may be renewed up to 3 additional one-year periods. The State may adjust the contract extension period to accommodate implementation. The original contract term or any renewal period may be extended at the State’s request on a month-to-month basis for a period not to exceed 6 months for the purpose of completing a future solicitation or transition to new contractor(s). Contract conditions, terms, and pricing shall not be modified during such a month-to-month extension Wisconsin statutes support purchasing goods/service from state certified Minority Business Enterprises (MBEs) and Disabled Veteran-owned Businesses (DVBs) located in Wisconsin. The Wisconsin Department of Transportation is committed to the promotion of state certified minority and disabled veteran-owned businesses in the State’s purchasing program.
