All bid proposals will be date and time stamped upon receipt. The Bidder is solely responsible for the timely delivery of the bid proposal and no bids shall be considered which are presented after the public call for receiving bids. Any bid proposal received after the date and time specified will be returned unopened, to the Bidder. Bids must be submitted on the standard Proposal Form provided by the Borough of Freehold in the manner designated therein, and must be enclosed in a sealed envelope bearing the title of the bid, name and address of the Bidder on the outside and delivered to the above address at the date and time set at the place herein. The Borough of Freehold is not responsible for any hand delivered or third party delivered bids, which do not arrive at the proper time or location. Any such bid will be returned unopened to the vendor. No substitutions, alterations, or modifications of any of the bid documents are permitted. The Borough of Freehold requires that a Bidder submit with his bid a bid guarantee in the form of a bid bond, certified check, or cashier's check in the amount of ten percent (10%) of the bid. In no case shall the bid guarantee exceed twenty thousand dollars ($20,000). Bid bonds shall be from a surety company licensed to do business in the State of New Jersey and acceptable. Bonds that are signed by an Attorney-in-Fact shall be accompanied by a certified Power-of-Attorney. Failure to include this item will result in mandatory rejection of the bid. The Successful Bidder will also be required to submit performance security, in the form of a performance bond, in an amount equal to one hundred percent (100%) of the annual value of the Contract. At the time of bid submission, all Bidders will be required to submit a Consent of Surety indicating that such surety will provide the performance bond if the Bidder is awarded a contract. The Successful Bidder will be required to comply with requirements of N.J.S.A. 10:2-1 (Anti-Discrimination in Employment), N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq. (Equal Employment Opportunity), 42 U.S.C. 12101 et seq. (Americans with Disabilities Act), N.J.S.A. 52:32-44 et seq. (New Jersey Business Registration), N.J.S.A. 52:25-24.2, and N.J.S.A. 52:32-55 et seq. Bidders shall not submit bids with qualifying conditions or provisions. The Borough of Freehold reserves the right to consider the bids for sixty (60) days after receipt thereof, and further reserves the right to reject any and all bids, waive informalities, and make such awards or take action as may be in the best interest of the Borough of Freehold and in accordance with applicable law.
