The OWNER reserves the right to waive any informalities or minor defects and to reject any and all BIDS. Any BID received after the specified date and time shall not be considered. No Bid Security shall be required for this project Neither the OWNER nor ENGINEER assumes any responsibility for errors or misinterpretations arising from BIDDER's reliance on a partial or incomplete set of Contract Documents nor failure to examine the Contract Documents thoroughly and/or to visit the project site and properly evaluate site conditions prior to submission of a BID. The submission of a BID will constitute a representation by a BIDDER that he/she has: carefully read and understands the Contract Documents; visually inspected the project site to his/her satisfaction; and is prepared to complete all Work required under the Contract Documents for the lump sum price specified on his/her BID FORM. Should any prospective BIDDER have questions regarding the meaning and intent of any provision of the Contract Documents, appropriate inquiry may be made to ENGINEER via email to skeach@keachnordstrom.com on or before 4:00 PM local time on Wednesday, September 25, 2024. Questions, if any, which in the ENGINEER's opinion require interpretation, will be promptly answered via written Addendum distributed to all registered BIDDERS via email on or before 4:00 PM on Thursday, September 26, 2024. Only questions answered by Addenda issued by ENGINEER shall be binding The OWNER reserves the right to reject any BID for any reason the OWNER determines to be in its best interest and to award a contract to the CONTRACTOR who, in OWNER's sole opinion submits the most reasonable and responsible low BID. OWNER anticipates the contract will be awarded on or about September 30, 2024. PERFORMANCE AND PAYMENT BOND, INSURANCE CERTIFICATE The BIDDER to whom this Work is awarded shall be required to execute an AGREEMENT and deliver Performance and Payment Bonds and a Certificate of Insurance to OWNER within ten (10) calendar days of issuance of Notice of Award by OWNER. In case of failure of BIDDER to execute an AGREEMENT, or to furnish required Bonds and/or Insurance Certificate, within said ten day period, OWNER shall reserve the right to deem BIDDER in default and nullify Notice of Award. Notice to Proceed shall be issued by OWNER without delay upon receipt of executed AGREEMENT and receipt of required bonds and insurance certificate. All Work to be performed under the AGREEMENT between OWNER and CONTRACTOR shall commence on or before October 21, 2024, AND be substantially complete on or before November 22, 2024.
