Site work and paving for a mixed-use development in Moreno Valley, California. Completed plans call for site work for a fitness / recreation center; road / highway; and for paving for a road / highway.

The City of Moreno Valley (City) requests the submission of Request for Qualifications (RFQual) from qualified firms to provide Design-Build services. You are hereby invited to submit a completed Pre-Qualification Questionnaire and other material requested herein, as well as attachments for Moreno Valley Utility. Question & Answer Deadline: October 10, 2024, 2:00pm All questions, technical, commercial, or contractual in nature shall be directed to the Q&A section. for the furnishing to City of responses from qualified firms to design, fabricate, deliver, install, and commission 700 KiloWatt DC and 4 Megawatt/8 Megawatt hour battery energy storage system on existing City owned land. The new microgrid will provide system reliability during an outage to the CRC and nearby loads. . RFQual shall be valid for a period of three hundred, sixty-five (365) calendar days after the Bid opening date. The City of Moreno Valley has determined that all Design-Build Entities on the Conference and Recreation Center Microgrid project to be undertaken by the City of Moreno Valley must be pre-qualified prior to submitting a bid on that project. It is mandatory that all Design-Build Entities who intend to submit a bid, fully complete the Pre-Qualification Questionnaire, found in Section 16 -Attachments, provide all materials requested herein, and be approved by the City of Moreno Valley to be on the final qualified Design-Build Entities list. No bid will be accepted from a Design-Build Entity that has failed to comply with these requirements. If two or more business entities submit a bid as part of a Joint Venture, or expect to submit a bid as part of a Joint Venture, each entity within the Joint Venture must be separately qualified to bid. The last date to submit a fully completed questionnaire is Thursday, October 17, 2024. Design-Build Entities are encouraged to submit pre-qualification packages as soon as possible. Answers to questions contained in the attached Pre-Qualification Questionnaire, information about current bonding capacity, notarized statement from surety, and the most recent reviewed or audited financial statements, with accompanying notes and supplemental information, and non-collusion affidavit are required. The non-collusion affidavit is found in Section 16 - Attachments. The City of Moreno Valley will use these documents as the basis of rating Design-Build Entities in respect to the size and scope of contracts upon which each Design-Build Entity is qualified to bid. The City of Moreno Valley reserves the right to check other sources available. The City of Moreno Valley's decision will be based on objective evaluation criteria. The City of Moreno Valley reserves the right to adjust, increase, limit, suspend or rescind the pre-qualification rating based on subsequently learned information. Design-Build Entities whose rating changes sufficient to disqualify them will be notified, and given an opportunity for a hearing consistent with the hearing procedures described in the Notice of Appeal section of this RFQual for appealing a pre-qualification rating. While it is the intent of the Pre-Qualification Questionnaire and documents required therewith to assist the City of Moreno Valley in determining bidder responsibility prior to bid and to aid the City of Moreno Valley in selecting the lowest responsible bidder, neither the fact of pre- qualification, nor any pre-qualification rating, will preclude the City of Moreno Valley from a post-bid consideration and determination of whether a bidder has the quality, fitness, capacity and experience to satisfactorily perform the proposed work, and has demonstrated the requisite trustworthiness. The pre-qualification packages submitted by Design-Build Entities are not public records and are not open to public inspection. All information provided will be kept confidential to the extent permitted by law. However, the contents may be disclosed to third parties for purpose of verification, or investigation of substantial allegations, or in the appeal hearing. State law requires that the names of Design-Build Entities applying for pre-qualification status shall be public records subject to disclosure, and the first page of the questionnaire will be used for that purpose. Each Pre-Qualification Questionnaire must be signed under penalty of perjury in the manner designated at the end of the form, by an individual who has the legal authority to bind the Design-Build Entity on whose behalf that person is signing. If any information provided by a Design-Build Entity becomes inaccurate, the Design-Build Entity must immediately notify the City of Moreno Valley and provide updated accurate information in writing, under penalty of perjury. The City of Moreno Valley reserves the right to waive minor irregularities and omissions in the information contained in the pre-qualification application submitted, to make all final determinations, and to determine at any time that the pre-qualification procedures will not be applied to a specific future public works project. Design Start: February 2025 Design Complete: April 2025 Construction Start: May 2025 Construction Complete: August 2025 Contractor's License The City requires the following licenses: No Bid will be accepted from a Bidder who, at the Bid Deadline, is not fully and properly licensed as a contractor in accordance with Chapter 9 of Division 3 of the California Business and Professions Code (Section 7000 et seq.). At the Bid Deadline, the prime Contractor must hold an active Class "A" contractors license issued by the California Contract State License Board or a combination of Class "C" specialty contractors licenses issued by the California Contract State License Board necessary for the performance of all Work to be performed by the prime Contractor. All Subcontractors shall be properly licensed at the Bid Deadline. Design-Build Entity's Insurance The successful Design-Build Entity shall not commence the work until it has obtained all insurance required herein and as specified in the attached Design-Build Agreement and obtained City approval of such required insurance as to form, amount, and carrier. The successful Design-Build Entity shall not allow any subcontractor to commence work on its subcontract until any such subcontractor has obtained the same insurance coverage required of the Design-Build Entity. Sample Design-Build Agreement and Sample Certificate of Insurance can be found in Section 16 - Attachments. Bonding Requirements The final Design-Build Entity selected through the RFP process shall furnish a satisfactory Faithful Performance Bond meeting all statutory requirements of the State of California on the form provided by the City. The bond shall be furnished as a guarantee of the faithful performance of the requirements of the Contract Documents as may be amended from time to time, including, but not limited to, liability for delays and damages (both direct and consequential) to the City and the City's Separate Contractors and consultants, warranties, guarantees, and indemnity obligations, in an amount that shall remain equal to one hundred percent (100%) of the Contract Price. The final Design-Build Entity selected through the RFP process shall furnish a satisfactory Labor and Materials Payment Bond meeting all statutory requirements of the State of California on the form provided by the City in an amount that shall remain equal to one hundred percent (100%) of the Contract Price to secure payment of all claims, demands, stop notices, or charges of the State of California, of material suppliers, mechanics, or laborers employed by the Contractor or by any Subcontractor, or any person, form, or entity eligible to file a stop notice with respect to the Work. Examination of the Site The Design-Build Entity who are considered Qualified shall visit the Site and determine the local conditions which may in any way affect the performance of the work; familiarize itself with all federal, state and local laws, ordinances, rules, regulations, and codes affecting the performance of the work, including the cost of clearances, permits, and licenses required for the work; make such surveys and investigations, including investigation of subsurface or latent physical conditions at the Site or where work is to be performed, as it may deem necessary for performance of the work at its proposal price; determine the character, quality, and quantities of the work to be performed and the materials and equipment to be provided; and correlate its observations, investigations, and determinations.
