The City of Napa, a California charter city ("City"), will accept bids from qualified suppliers (a "bidder" or "bidders") to provide the City with hot mix asphalt (HMA), aggregate base, sand, drain rock, cold patch, and various types of asphalt and aggregate materials as specified in the scope, as further specified (collectively, "Goods"), on an as-needed basis, as determined by City. Scope of Services Upon written request by the City's Authorized Representative or designee, Supplier shall provide hot mixed asphalt, aggregate base, backfill sand, tack oil and crushed rock to the City for the Napa Neighborhood Streets and Sidewalks Program in the amounts requested on or before the date set forth in a written request. The successful bidder will provide Goods to City on an as-needed basis, as determined by City, pursuant to individual written requests issued by City via email (individually, a "Written Request," collectively, "Written Requests"), as further specified herein. There is no guarantee as to the quantity of Goods requested by City or the number of Written Requests issued by City. The Goods are generally described as follows: hot mix asphalt (HMA), aggregate base, sand, drain rock, cold patch, and various types of asphalt and aggregate materials as specified in the scope. Description. The Goods are generally described as follows: hot mix asphalt (HMA), aggregate base, sand, drain rock, cold patch, and various types of asphalt and aggregate materials as specified in the scope. The City intends to award one (1) agreement for the purchase of these materials with a not to exceed amount of $6,500,000 and no minimum amount that must be spent. The Goods must be provided to the City as specified within 10 working days from the date City issues a written request to the successful bidder (the "Deadline"). The City will issue written or verbal requests as needed based on City operations over the next three years, but this anticipated timeframe is provided solely for convenience and is neither certain nor binding. City reserves the right to postpone the date or time for receiving or opening bids. The bid price must include all costs to provide the Goods to City, as further specified in the Contract Documents, including all labor, material, supplies, and equipment and all other direct or indirect costs such as applicable taxes, insurance and overhead. Question Deadline 10/10/2024. Questions or requests for clarifications regarding the Goods, the bid procedures, or any of the Contract Documents must be submitted electronically, in writing. Oral responses are not authorized and are not binding on the City. Bidders should submit any such written inquiries at least five Working Days before the scheduled bid deadline. Questions received any later might not be addressed before the bid deadline. An interpretation or clarification by City in response to a written inquiry will be issued in an addendum. Any addenda issued prior to the bid deadline are part of the Contract Documents. Subject to the limitations of Public Contract Code 4104.5, City reserves the right to issue addenda prior to bid time. Each bidder is solely responsible for ensuring it has received and reviewed all addenda prior to submitting its bid. If the City releases an addendum, it will be posted electronically. Reservation of Rights Subject to the provisions of its Charter and the NMC, City reserves the unfettered right, acting in its sole discretion, to waive or to decline to waive any immaterial bid irregularities; to accept or reject any or all bids; to cancel or reschedule the bidding process; or to postpone or abandon a purchase entirely. The Contract will be awarded, if at all, within 60 days after opening of bids, to the lowest responsible bidder, as defined in the Lowest Responsible Bidder section. City expressly disclaims responsibility for any assumptions a bidder might draw from the presence or absence of information provided by City in any form. Each bidder is solely responsible for its costs to prepare and submit a bid.
