The use of streaming video for bid openings is provided as a convenience for bidders. Should the steaming link access be unavailable or fail during a bid opening, it does not nullify the validity of the process or results. If the County Government closes in response to an emergency declaration, an Addendum may be issued to temporarily stop the solicitation process until the County Government resumes operation. This is a Locally-Administered, Federally Funded Project. In accordance with Contract Special Provision the successful bidder shall adhere to Buy America requirement. A Disadvantage Business Enterprise (DBE) participation goal of 7% is established. To be determined a "responsive" bidder, all bidders shall achieve good faith efforts meeting the DBE goal in accordance with 49 Code of Federal Regulations (CFR, Part 26, Appendix A. All Bidders shall be VDOT prequalified for determination as a Responsive Bidder. Generally, the project consists of the construction of traffic signals at the intersection of Dumfries Road (Route 234 and Talon Drive (Route 3465. The project includes modification of a median on Talon drive, two signal poles with mast arms, pedestrian crossing infrastructure, signing and pavement markings, right of-way acquisition, and ADA handicap ramps. The County will not be responsible for any other explanations or interpretations of the Bidding Documents or Contract Documents unless made by formal Addenda. No employee or agent of the County shall have the authority to furnish any other explanation or interpretation, verbal or written. All Bidders shall have a valid certificate of authority or registration to transact business in Virginia with the Virginia State Corporation Commission as required by Title 13.1 or Title 50 of the Code of Virginia at time of bid submission. In accordance with Prince William County Procurement Regulations, the County reserves the right to reject any bids, waive informalities and irregularities in bidding, and to accept bids, which are, in consideration, in the best interest of the County. The Bidder shall use the Bonding forms included with the Bidding Documents. If a certified check or a cashiers' check is submitted as the Proposal Bid Bond, the check is to be made payable to Chief Procurement Officer, Prince William County, and the project name and Contract Number shall appear on the face of the check, as well as the business name of the Bidder. The Contractor shall furnish along with the required number of copies of the Contract duly signed by him, two (2) originals of Performance and Payment Bonds, (forms included in the Bid Documents), each in an amount equal to one hundred percent (100%) of the Contract Sum. Bonds shall be properly issued and executed by a Surety licensed in the State of Virginia and acceptable to the County. Cost of Bonds shall be included in the total estimated Bid Price. The Performance Bond shall remain in effect for one (1) year after final acceptance. The cost of obtaining Bonds shall be included in the Summary of Unit Bid Prices under the item for Mobilization. The Contractor shall deliver the required Bonds to the County not later than the date of execution of the Contract. However, such Bonds shall not be delivered later than five (5) calendar days after Award of the Contract by the Board of County Supervisors. The Contractor shall require the Attorney-in-Fact who executes the required Bonds on behalf of the Surety to affix thereto a certified and current copy of his power of attorney indicating the monetary limit of such power. The Contractor shall use the Performance Bond and Payment Bond forms included in the Contract Documents and both shall be written in the amount of the Contract Sum.
