Provide Labor and Materials for Hot Springs Stokes Creek Greenway Trail Phase 1 (Tap-22) (S); Ardot Job 061770 Question Deadline 10/25/2024 at 5:00 PM CT Section 106, Control of Material, of the Standard Specifications for Highway Construction, Edition of 2014, is hereby amended as follows: The following is added as Subsection 106.01(c) Construction Materials Buy America - Construction Materials. (1) General. The Bipartisan Infrastructure Law (BIL) was enacted on November 15, 2021 (BIL Build America, Buy America Act Publication L. No. 117-58). This provision expands the Buy America requirements beyond what was only required for steel and iron products. The steel and iron provisions have not changed with the new law. Buy America requirements are in effect only on Federal-Aid contracts and all construction materials shall be produced/manufactured in the United States. Items specifically excluded from this requirement are cement and cementitious materials; aggregates such as stone, sand, or gravel; aggregate binding agents or additives (including asphalt binders). All other materials permanently incorporated into the project will be subject to Buy America requirements. (2) Definitions. A construction material includes an article, material, or supply that is or consists primarily of: o non-ferrous metals; o plastic and polymer-based products (including polyvinylchloride, composite building materials, and polymers used in fiber optic cable); o glass (including optic glass); o lumber; or o drywall. Items manufactured through a combination of either two or more materials listed above, or at least one of the materials listed above and a material not listed shall be considered as a manufactured product, rather than as a construction material. Build America, Buy America provisions specified for manufactured products in Section 70912(6)(B) of the Infrastructure Investment and Jobs Act (IIJA) do not apply to federal-aid construction projects per FHWA's existing statutory requirement applicable to manufactured products. A "manufactured product" is considered to be an item that undergoes one or more manufacturing processes before the item can be used on a construction project. All construction materials shall be produced in the United States. This means all manufacturing processes to produce the construction materials shall occur in the United States. All manufacturing processes for construction materials shall mean the final manufacturing process and the immediately preceding manufacturing stage for the construction material. (3) Compliance. The Contractor shall ensure that all manufacturing processes for each covered product comply with this Buy America Provision. Non-conforming products shall be replaced at no expense to the Department. It is the contractor's responsibility to assure all submittals required for Buy America are submitted to the Engineer prior to the products and or materials being incorporated into the project. Scope of Work means the description/specifications of the item or items to be furnished, and/or installed and/or provided and the work to be performed in conjunction therewith or otherwise as determined and described by the City as identified by drawings, specifications, and instructions included in this packet. The Contractor shall provide all labor, equipment, and materials to prepare the work areas and to complete the work as shown on the plans and described in the specifications and bid documents. A. ITEMS OF WORK THAT ARE TO BE INCLUDED IN THE BID In addition to the work and materials required to finish the work, the following shall also be included: - Taxes and fees - Permit costs - Traffic control measures and traffic plans - Location of Utilities - Temporary access to buildings - Tape, signage, and posts to mark alternate pedestrian routes - Tape, signage, and posts to mark alternate vehicle access routes - Notification of property owners - Saw cut and removed the existing concrete - Off-site disposal of removal items - Removal of grass and soil to subgrade - Subgrade preparation and compaction - Root pruning - Removal of shrubs, trees, and roots up to 12" in diameter - Removal of soils and rock to the depth required for the improvements - Furnish and place Class 7 Base - Concrete forms - Placement of concrete - Ready-mix concrete - Concrete finishing - Stripping forms - Expansion joints - Rebar and other embedment materials - Placement of rebar and embedded items - Backfill and finish grading - Replacement of topsoil, grass, or sod - Coordinate with utilities to relocate or reposition utility boxes and appurtenances B. WORK EXCLUDED AND FURNISHED BY OTHERS (Unless specified in the contract plans and/or documents): - Irrigation C. GENERAL REQUIREMENTS The Contractor shall notify residents and property owners of the upcoming work and shall coordinate to provide continuous access to their properties, homes, and businesses. The Contractor shall obtain photo documentation of existing walls, sidewalks, curbs, mailboxes, gates, and other similar items before the work begins. Damage to utilities, retaining walls, landscaping, mailboxes, fences, etc., are the responsibility of the contractor. The Contractor shall notify the City 24 hours in advance of any street closings. The Contractor shall not park any vehicles or store materials or equipment on private property without prior written consent from the Property Owner. If consent is obtained, provide a copy to the City. The Contractor shall locate utilities or other items that may impede the completion of the project. The Contractor shall be responsible for traffic control measures and must comply with Manual on Uniform Traffic Control Devices (MUTCD) standards. However, the Contractor shall obtain City review and approval of the Contractor's traffic control plan before that segment of the work begins. If construction disrupts the public sidewalks, the Contractor shall provide a temporary safe alternate path. Upon completion of the work, the Contractor shall replace topsoil and sod or seed to match the existing lawn turf type. Straw, wheat, rye, and other annual grasses are not allowed for repairing lawns. Rebar, welded wire mesh, and other materials shall be new materials that have been protected and stored properly. Rusty scrap materials will not be accepted.
