A. The work includes furnishing all labor, materials, tools, equipment, and incidentals necessary, and for doing all the work involved in performing the work as shown and described in the plans and these specifications. 1. It is the intent of the plans and specifications to provide planting with plants in vigorous growth, ready for Citys use. Any items not specifically shown in the plans or called for in the specifications, but part of the work to conform with such intent, are to be considered as part of the work. C. Plant Establishment: The Contractor shall maintain entire landscape for one hundred eighty (180) days from substantial completion of landscape installation, in accordance with Section 02970 of these Special Conditions. Pursuant to Labor Code Section 1726, the City is required to take cognizance of violations of the public works laws. Then, either on its own or pursuant to a Notice to Withhold issued by the State Division of Labor Standards Enforcement (Labor Commissioner), the City is required to withhold contract payments to the Contractor in an amount specified in the notice. 2. Pursuant to Labor Code Section 1727, all progress payments, except the final payment, are subject to withholding either by the City or State Division of Labor Standards Enforcement (Labor Commissioner), only after a full investigation. Amounts withheld shall cover and all wages and penalties which have been forfeited. However, the final payment is subject to withholding pending completion of a full investigation. Before making payments to the Contractor of money due under the contract, the City will withhold and retain therefrom all wages and penalties that have been forfeited The work to be performed under this Contract generally consists of pavement rehabilitation of Woodruff Avenue, between Washburn Road and Foster Road, as shown on the Plans. This project includes reconstruction of failed pavement areas, cold milling of asphalt pavement; construction of fiber-reinforced asphalt concrete (AC) base course and asphalt rubber hot mix (ARHM) overlay. Work also includes construction of raised center median islands, repair of uplifted, damaged or substandard concrete curb, gutter, sidewalk, drive approaches and curb ramps; installation of landscaping and irrigation in proposed center median islands and existing frontage road islands, adjustments of manhole and utility valve covers to the new grade, replacement of traffic striping, pavement markings and signing; traffic control and all appurtenant work thereto necessary for the proper construction of the contemplated improvements in accordance to Plans and Specification entitled Capital Improvement Project No. 14-14B
