PURCHASING AGENCY (STATE): Office of Management and Budget PROCUREMENT OFFICER: Seth Westby EMAIL: swestby@nd.gov PHONE: 701-328-1953 CONTRACTOR, in exchange for the compensation paid by STATE under this Contract, shall provide the commodities and services described in this solicitation. The State Procurement Office (STATE) is requesting bids to provide all labor, materials, equipment and supplies necessary to provide waste/garbage disposal and recycling services for various State agency locations throughout North Dakota. The following cities listed in Attachment A is not all inclusive, but representative of those State agencies who have expressed interest and may wish to contract for the services in this solicitation document. Other locations may be added in accordance with Special Terms and Conditions item #4 of this IFB. CONTRACTOR RESPONSIBILITIES o The Contractor shall be responsible for the collection, transportation, and disposal of waste/garbage and recyclable materials at designated facilities in accordance with all local, state, and federal laws. o The containers provided by the Contractor shall be equipped with workable lids and doors, and be new or newly reconditioned at the start of service. The containers shall also be properly maintained and placed on level ground. Maintenance shall include: painting of containers and or removal of graffiti, properly functioning lids, properly functioning wheels on containers with such equipment, and any other preventative maintenance required to maintain containers in a condition acceptable to the agency. o The Contractor is obligated to sanitize containers which shall include cleaning the interiors and deodorizing the containers at least once per week. Any compactor shall be removed from the premises and cleaned professionally as required by manufacturer, contractor, or as requested by agency. o The Contractor shall spray each container for pests (bees and flies) from May until October, upon emptying on the regular pickup schedule if requested by the agency. o All solid waste or recyclable materials removed from the premises by the Contractor must be delivered to a certified landfill, incinerator, or recycling facility. If the Contractor fails to dispose of recyclable materials through a recycling facility, this may be cause for termination of the contract. Using agency reserves the right to randomly request proof of proper recycling services o Pickup days scheduled by the using agency are mandatory. Any changes to pickup days require advance written approval of the agencies' contract administrator or designee. Additional pickups may be required, however, no additional pickups for any area shall be allowed unless specifically requested and authorized by the contract administrator or designee. The Contractor shall, within 24 hours after being notified by the contract administrator or designee, make additional pickups. o The Contractor's operators shall be responsible for the cleanup of all spillage that may occur in the course of making a pickup. The Contractor shall provide adequate supervision over the work being performed and will be held solely responsible for the conduct and performance of its employees and others involved in the execution of this contract. o Contractor shall maintain its pickup vehicles so that they do not leak excessive amounts of fluids on the grounds of the facility. The Contractor shall be responsible for cleanup of fluids that leak from its vehicles. o Where it has been determined by the contract administrator that the parking lot, or grounds, has been littered as a result of the collection of refuse, the Contractor will be notified and shall dispatch its employees to the building immediately to remove the litter. o An annual contract activity report must be submitted on the anniversary date of the contract to the contract administrator at the awarded location. The report must contain, at a minimum, identification of the agencies using the contract, types and sizes of containers being used by agencies, the frequency of pickup at each agency and the landfill fees paid for each agency. o Service personnel will be professional and courteous. It is preferred that service personnel wear uniforms provided by the Contractor. At a minimum, service personnel must have Contractor supplied identification badges. o The Contractor must comply with reasonable agency requests, such as locks on containers, affixing of no parking stickers, etc. at no additional cost. o The Contractor shall add or replace dumpsters and recycling containers/totes at the discretion of the agencies contract administrator or designee within seven (7) calendar days of receiving the request o Five day a week business service must be provided. The Contractor shall respond to irregularities in waste generation. The Contractor shall respond within 24 hours to any unscheduled/special pick-ups requested by the contract administrator or designee, excluding any state holidays.
