a) The Village of Upper Nyack, Rockland County, New York, proposes make certain improvement in accordance with the plans entitled Kuyper Dr Pipe Repair b) The Contractor shall furnish, at his own expense, all plant, labor, materials, supplies, equipment, and other facilities and things necessary for or proper for or incidental to the work of this Contract, within the time limits stipulated in these Contract Documents, and in strict accordance with the Applicable Plans, thereinafter enumerated, the Specifications and Addenda, the General Conditions, these Special Conditions, and all other requirements of the Contract Documents, and in strict accordance with such changes as are ordered and approved pursuant to this Contract and shall perform all other obligations imposed on him by the Contract. c) The Contractor shall prepare a Work Progress Schedule for the project in the form of a Bar Graph which he shall submit to the Engineer for review. Upon approval, this Work Schedule Bar Graph shall be exhibited at the Contractor's job site office, and shall be reviewed and updated as required. DESCRIPTION OF WORK. BID ALTERNATE A Sawcut existing pavement, remove and replace existing CMP with HDPE ADS N-12 or equal, install new pavement with asphalt hotseal, install new asphalt berm as needed, restoration of grass areas and ancillary work as required for complete installation. BID ALTERNATE B Rehabilitate existing CMP by the Cured in Place Pipe (CIPP) method Service-Disabled Veteran-Owned Set Aside: No Contract term: 3 month PLEASE TAKE FURTHER NOTICE that all bids and proposals must be accompanied by a Statement of Non-Collusion in conformity with requirements of Section 103-d of the General Municipal Law. The Village Board reserves the unrestricted right to accept or reject any and all bids and to waive informalities therein. 12.BID SECURITY. Each bid must be accompanied by cash, cashier's check, certified check of the bidder, or bid bond, prepared on the form of bid bond attached hereto, duly executed by the bidder as principal and having as surety thereon a surety company approved by the Owner, in an amount not less than five percent (5%) of the amount of the bid. Such cash, checks or bid bonds will be returned to all except the three (3) lowest formal bidders within ten (10) days after the formal opening of bids and the remaining cash, checks, or bid bonds will be returned to the three (3) lowest bidders within forty-eight (48) hours after the Owner and the accepted bidder have executed the Contract, or if no Contract has been so executed, within forty-five days after the date of the opening of bids, upon demand of the bidder at any time thereafter so long as he has not been notified of the acceptance of his bid. 13.LIQUIDATED DAMAGES FOR FAILURE TO ENTER INTO CONTRACT. The successful bidder, upon his failure or refusal to execute and deliver the Contract and Performance Bond required within ten (10) days after he has received notice of the acceptance of his bid, shall forfeit to the Owner as liquidated damages for such failure or refusal, the security deposited with his bid, or the amount of bid bond. 14.BASIS OF AWARD. The Contract will, at the discretion of the Owner, be awarded on the basis of competitive bids to the lowest responsible eligible bidder. It is the purpose of the Owner not to award the Contract to any bidder who does not furnish satisfactory evidence that he is responsible and that he has sufficient capital, ability, experience, and plant to enable him to prosecute the work successfully, and to fulfill all the requirements of the Contract. 15.REJECTION OF BIDS. The Owner reserves the right to reject any or all bids, or to accept any bid should it deem it to be for its best interest so to do. Bids not prepared and submitted in accordance with the provisions of Information for Bidders, and for bids which are incomplete, conditional, or obscure, or which contain additions not called for, erasures, alterations, or irregularities of any kind, may be rejected as informal. Contractor's Bond to Secure Owner Against Loss a) The Contractor shall furnish a Performance Bond and Labor and Materials Payment Bond on the form provided, in a total amount equal to at least one hundred percent (100%) of the Contract prices as security for the faithful performance of this Contract and for the payment of all persons performing labor on the project under this Contract and furnishing materials in connection with this Contract. The surety on such bond shall be a duly authorized surety company satisfactory to the Owner. The premiums on such bond shall be paid by the Contractor.
