Bidders are required to register on this website as plan holders, regardless of whether they obtain the bidding documents from the designated website or another source, either electronically or in paper format. The designated bidding website will be regularly updated with addenda, lists of registered plan holders, reports, and other pertinent information crucial for submitting a bid. The Owner and Engineer shall not be held responsible for any bidding documents, including addenda, acquired from sources other than the designated bidding website. Question Deadline 10/30/2024 Online - Q&A The contract will be granted to the bidder who offers the lowest price, demonstrates responsiveness and responsibility, and has been pre-qualified. The Owner retains the authority to rectify any minor clerical errors in the bids as permitted by Oklahoma Law. Furthermore, the Owner maintains the right to refuse any or all bids as outlined in accordance with the Oklahoma Public Competitive Bidding Act of 1974. Bids submitted with conditions will not be considered. For all further details regarding bid submission, qualifications, procedures, and contract award, please refer to the Instructions to Bidders included in the Bidding Documents. Bids must remain valid for 90 days following the bid opening date. Within this period, the Owner retains the right to award the contract to the lowest responsive, responsible bidder or reject any or all bids for the project. Each bidder must submit their original bid, lodged with the City of Minco/Minco Municipal Authority, accompanied by a certified or Cashier's Check from a solvent Oklahoma bank, or a Bidder's Bond. This bond must be equivalent to five (5) percent of the bid amount, serving as a guarantee of the bidder's capability to fulfill the contract bid and enter into a written agreement with the Owner. This agreement obligates the bidder to execute the work and/or supply the materials in compliance with the provided Plans and Specifications, as well as furnish the necessary bonds in accordance with the requirements of the Public Competitive Bidding Act of 1974. The Owner will withhold the deposit as liquidated damages if the successful bidder fails to execute the contract and provide the specified bonds within the allotted timeframe. Deposits from unsuccessful bidders will be returned upon the completion of the Contract and provision of required bonds. Each bidder shall accompany his bid with a sworn statement in writing that the bidder has not directly or indirectly entered into an agreement, expressed or implied, with any other bidder concerning the price or amount of such bid or any bids, the limiting of the bids or bidders, the paying to anyone any money for promotion expenses, the parceling or farming out to any bidder or bidders or other persons of any part of the contract or any part of the subject matter of the bid or of the profits thereof. As such, compliance with the Davis Bacon Act, American Iron and Steel, and Labor Standards Contract Provisions is mandatory. Construction, Maintenance, and Statutory Payment Bonds, amounting to 100% of the contract price, are mandatory for this project. These bonds must be secured from a Corporate Surety licensed in Oklahoma and approved by the Owner and Consulting Engineer. The bidder must identify the Surety or Sureties responsible for signing the bond if the contract is awarded. The Maintenance Bond will ensure the repair of any damage resulting from faulty materials or workmanship for a period of one (1) year following the Owner's acceptance of the work. This project is to be financed by a CWSRF loan from the Oklahoma Water Resources Board (OWRB) and shall be referred to as Project No. ORF- 24-0009-CW. The bidder commits itself to following the good faith efforts to solicit disadvantaged business enterprises contained herein and all other requirements, terms and conditions of these bid conditions by submitting a properly signed bid. Requirements are contained in OWRB's Guidance and Procedures, ORF-267." "Davis Bacon Act wage rules shall apply. All laborers and mechanics employed by contractors and sub-contractors on projects funded directly by or assisted in whole or in part by and through the Federal Government shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of Chapter 31 of Title 40, United States Code and 29 CFR parts 1,3, and 5. The Department of Labor provides all pertinent information related to compliance with labor standards, including prevailing wage rates and instructions for reporting. For more information please refer to Oklahoma Water Resources "American Iron and Steel provisions also apply to projects funded directly by or assisted in whole or in part by and through the Federal Government pursuant to P.L. 113-76, Consolidated Appropriations Act, 2014, Sec. 436 requires that "None of the funds made available by a State water pollution control revolving fund as authorized by title VI of the Federal Water Pollution Control Act (33 U.S.C. 1381 et seq.) or made available by a drinking water treatment revolving loan fund as authorized by section 1452 of the Safe Drinking Water Act (42 U.S.C. 300j-12) shall be used for a project for the construction, alteration, maintenance, or repair of a public water system or treatment works unless all of the iron and steel products used in the project are produced in the United States." For more information please refer to Oklahoma Water Resources Board Supplemental Conditions ORF-185." "System for Award Management (SAM) registration is required for all SRF programs (CWSRF and DWSRF) applicants and Awardees (Entities, Prime Contractors, Subcontractors, Vendors) in order to be awarded contracts by the SRF Programs. SAM replaces Central Contractor Registration/Federal Agency Registration, Online Representations and Certifications Application, and Excluded Parties List System. Applicants and awardees are required to complete a one-time free registration to provide basic information relevant to procurement and financial transactions. Registrants must retain an active status to be eligible for SRF projects. New Applicants and Awardees can go to SAM.gov to complete the registration process." The Owner reserves the right to reject any or all bids, waive irregularities in bids deemed to be in the best interests of the Owner, and reject nonconforming, nonresponsive, or conditional bids. In the event of ambiguity or lack of clarity in bid pricing, the Owner reserves the right to interpret bids in the most advantageous manner or reject them outright. The contract is to be awarded to the lowest, responsive, responsible bidder. The Owner reserves the right to correct any non-material clerical errors in the bidding as allowed under Oklahoma Law. The Owner reserves the right to reject any and all bids in accordance with the Oklahoma Public Competitive Bidding Act of 1974. Conditional bids shall not be accepted.
