Site work, new construction and renovation of a municipal facility in Johnstown, Pennsylvania. Completed plans call for the construction of a municipal facility; for the renovation of a municipal facility; and for site work for a municipal facility.

Bids shall be submitted in accordance with these instructions and all other Contract Documents identified in this Agreement; deviations may be rejected as nonconforming. All civil plans and specifications are attached for reference only and are not part of the bid. The PEMB will be provided for the main hauling facility there are modifications that are required to be made to the PEMB. Refer to NUCOR drawings for the required changes. Bidders shall submit a complete Exhibit A, including the Schedule of Values. Bidders shall also submit a detailed project schedule based on the start and finish dates provided in Exhibit A, and a list of equipment to be used on the project(s) with corresponding hourly rates. Bids shall be sealed in an opaque envelope, marked with title of work, name, and address of Bidder, and accompanied by other required documents. Bids may be submitted by email to: rdunlap@wm.com provided the hard copy is delivered to the above address on the next business day. After official Bid closing time, bids will be opened privately. This letter and all attachments are considered strictly confidential and are provided only as Bid Documents for procurement of services. OWNER reserves right at its sole discretion to reject any and all proposals, to waive any and all irregularities, and to negotiate terms with successful Bidder. OWNER may conduct such investigations, as it deems necessary to assist in evaluation of any Bid and to establish responsibility, qualifications, and financial ability of any Bidder, subcontractor, vendor, and other persons and organizations proposed to perform and furnish Work. OWNER shall have right to accept alternates or a conditional or qualified Bid. Your Bid may not be terminated or withdrawn until sixty (60) days after submittal deadline stated above. Copies of Bidding Documents: Complete sets of Bidding Documents shall be used in preparing bids, neither OWNER nor ENGINEER assume any responsibility for errors or misinterpretations resulting from the use of incomplete sets of Bidding Documents. Examination of Contract Documents: It is the responsibility of each Bidder, before submitting a Bid, to (a) examine the Contract Documents thoroughly, (b) consider federal, state, and local laws and regulations that may affect cost, progress, performance or furnishing of the work, (c) study and carefully correlate Bidder's observations with the Contract Documents, (d) notify OWNER of all conflicts, errors or discrepancies identified by the Bidder upon examination of the Contract Documents, and (e) become familiar with the OWNER's site regulations. Examination of Site: It is the responsibility of each Bidder, before submitting a Bid, to inspect the site as required by the Contract Documents to become familiar with local conditions that may affect cost, progress, performance or furnishing of the work. Before submitting a Bid, each Bidder shall, at Bidder's own expense, make or obtain any additional examinations, investigations, exploration, tests and studies and obtain any additional information and data that pertain to the physical conditions (surface, subsurface, and underground facilities) at or contiguous to the site or otherwise which may affect cost, progress, performance or furnishing of the work and which Bidder deems necessary to determine the Bid for performing and furnishing the work in accordance with the terms and conditions of the Contract Documents. On request in advance, OWNER will provide Bidder reasonable access to the site to conduct such explorations and tests as each Bidder deems necessary for submission of a Bid. Bidder shall fill all holes, clean up, and restore the site to its former condition upon completion of such explorations. Questions: All efforts have been made to provide adequate and accurate information; however, should you note any discrepancies or items that have not been included, credit will be given during the evaluation phase to those who correct or include missing items. Questions regarding the project and bidding procedure shall be directed to the LDG BID PLAN Site. All questions must be submitted in writing no later than August 14th. Answers to questions and any addenda to the bid package will be provided in written or electronic format for the benefit of all bidders. Contract Time: For purposes of planning the work and setting project schedules, the Contractor should plan on notice to proceed to be given on September 6th. The project can start and must be completed by the dates provided in Exhibit A. Schedules: Bidder shall prepare and submit a construction schedule for the project bid. The schedule shall be in a timeline format and must be based on the start and finish dates provided in Exhibit A. Special consideration will be given to the contractor with the shortest overall schedule. Bid Form: Only the information contained in Exhibit A, attached hereto, is to be used. Bidder is required to bid each complete unit for each item as called for, and to set forth all allowances. Total or estimated (as indicated) bid "Contract" shall be provided to OWNER in a numeric format. Bidder may offer prompt payment discounts for approval by OWNER. Bidders must complete and submit Exhibit A, a Project Schedule, and an Equipment List. Bidder's Representation: By the act of submitting a Bid, Bidder represents that it is experienced and qualified to perform the services required by the Contract Documents and is properly staffed, organized, licensed, and financed to perform such services, and to commence such services immediately. Modification and Withdrawal of Bid: Bids may be modified or withdrawn by giving notice to the party receiving Bids at the place designated for receipt of Bids any time prior to opening of Bids. A withdrawn Bid may be resubmitted up to the time designated for the receipt of Bids provided that it is then fully in conformance with these Instructions to Bidders. Bids will be opened privately. Award of Contract(s): OWNER reserves the right in its sole discretion to reject any and all Bids, to waive any and all irregularities in Bids and to negotiate contract terms with the successful Bidder. Site Safety: The Contractor will observe all WM safety policies during the life of the project, and will be required to sign a standard safety declaration (included with the contractual documents) prior to the beginning of work. Failure to observe the policies may result in personnel being required to leave the project site and/or termination of work. Supplier Diversity: Owner and Contractor shall support the utilization of minority, woman and veteran owned businesses in the performance of this Agreement, including firms certified as a DBE. WM is committed to identifying and increasing procurement spending with minority/women owned businesses, veterans and small disadvantaged businesses. Code of Conduct: WM has formally adopted a Supplier Code of Conduct ("Code") which establishes a set of guidelines to assist our consultants, contractors and suppliers in adhering to ethical business standards when doing business with or on behalf of us. If the Contractor has not previously reviewed and acknowledged receipt of the Code, then the Contractor should do so, prior to submitting a bid (or submit an acknowledgement with the bid) for the work. Special Conditions: The "Main Building" PEMB had been previously purchased by WM for another site. There are several modifications that will need to be made to the PEMB to be located at the proposed site. The manufacture of the building, NUCOR has engineered the required modifications, and their drawings are provided as part of the bid documents. The contractor will be required to pick up the PEMB that is currently located at the WM Laurel Highlands Landfill, 260 Laurel Ridge Rd, Johnstown, PA 15909. The contractor is required to make the modifications, remove all rust and primer the entire structure. The contractor that erects the PEMB is required to be a NUCOR certified contractor. All questions must be submitted in writing no later than August 14th
