Sandy, UT 84070 Phone: (801) 826-5345 Email: Chad.Pulsipher@canyonsdistrict.org Provisions of this contract are pursuant to the authority set forth in 63G-6a-101, et seq, Utah Code Annotated,1953, as amended, Utah State Procurement Rules (Utah Administrative Code Section R33) or CSD Purchasing Policy in accordance with the laws of the State of Utah, and related statutes which permit CSD to purchase certain specified services, and other approved purchases for CSD. The purpose of this request for Statement of Qualifications (SOQ) is to solicit competitive sealed proposals from qualified General Contractors to provide construction services for projects within Canyons School District (CSD) under $2,500,000.00 (total cost including construction, design, furniture, and equipment cost) following State Of Utah Rule R33-105-106.5. It is anticipated that this SOQ may result in a short-list of companies. These companies will then be invited to participate and bid on various projects located throughout CSD during the term of the contract. This will be a CLOSED-ENDED approved short-list per Utah State Procurement Code 63G-6a-507. This list will be utilized when the procurement of general contractor services are required for a project from November, 2024 through March, 2026. The intent of CSD is to short-list all qualified companies receiving a minimum score of 80 points or higher from the evaluation committee. No company receiving fewer than 80 points will be short-listed. Only short-listed companies will be invited to bid on future CSD projects between $0.01 and $2,500,000.00 (total cost including construction, design, furniture, and equipment cost) following State Of Utah Rule R33-105-106.5. This SOQ is designed to provide interested companies with sufficient basic information to submit proposals meeting minimum requirements, but is not intended to limit a proposal's content or exclude any relevant or essential data. Proposing firms are at liberty and are encouraged to expand upon the specifications to evidence service capability under any agreement. A. General Contractor Responsibilities The GC(s) selected for each project will be expected to fulfill the following requirements: 1. The GC shall supervise and direct the work, using their best skill and attention. The GC shall be solely responsible for all construction means, methods, techniques, sequences and procedures and for coordinating all portions of the work under the contract. 2. Unless otherwise specifically noted, the GC shall provide and pay for all labor, materials, equipment, tools, construction, equipment and machinery, water, heat, utilities, transportation, and other facilities and services necessary for the proper execution and completion of the work. 3. The GC shall at all times enforce strict discipline and good order among their employees, and shall not employ any unfit person or anyone not skilled in the task assigned to him. 4. The GC warrants to the owner, architect, and or engineer that all materials and equipment incorporated in the work will be new unless otherwise specified, and that all work will be of good quality, free from faults and defects and in conformance with the bid documents. All work not conforming to these standards may be considered defective. 5. The GC shall be responsible for the acts and omissions of all his employees, subcontractors, their agents, and all other persons performing any of the work while engaged in a contract with the GC. 6. The GC at all times shall keep the premises free from accumulation of waste materials or rubbish caused by his operations. At the completion of the work he shall remove all his waste materials and rubbish from and about the project as well as his tools, construction equipment, machinery and surplus materials, and shall clean all glass surfaces and shall leave the work clean and free from any and all debris, unless otherwise specified. 7. The GC shall indemnify and hold harmless the owner and their agents and employees from and against all claims, damages, losses and expenses including attorney's fees arising out of or resulting from the performance of the work. 8. It is agreed by the parties to the contract that if the GC shall fail to complete his work on or before the date set for substantial completion, or the extension thereof granted by the owner, damage will be sustained by the owner and that it is, and would be, impracticable and extremely difficult to fix the actual damages the owner would sustain. 9. The GC agrees that any sums which: may be due the owner as liquidated damages, may be deducted from any monies due, or that become due, the GC under the contract of may be collected from the contractor's surety. 10. GC must provide reports and attend any meetings required by CSD as the project progress. 11. CSD will require the GC to perform a final puchlist before the project will be signed off and deamed complete. The method of Contractor Selection has not been Determined at this time.
