Site work for a water / sewer project in Hesperia, California. Completed plans call for site work for a water / sewer project.

Brief Project Description: The City of Hesperia is soliciting bids for the rehabilitation of tank coatings to three of its potable water reservoirs. The Project includes, but is not limited to, performing the following work: o Cleaning and preparation of all surfaces of water tank and associated appurtenances for application of sealant/coatings/epoxies, including the removal of any sediment. o Removal of any sediment from interior of tank o Application of NSF/ANSI 61 sealant/coatings/epoxies, according to manufacturer's specifications. o Work shall comply with applicable standards set forth by the American Water Works Association (AWWA) (D-102-17 Coating Steel-Water Storage Tanks and C652-11 Disinfection of Water Storage Facilities), Association for Materials Protection and Performance (AMPP), and Society for Protective Coatings/NACE (SSPC). o Protect in place and shield telemetry equipment from overspray. o Supply and install new gaskets for any manways opened or disturbed at Plant 22. o Perform disinfection of tank at Plant 22 per AWWA standard. City will be responsible for obtaining samples and costs associated with microbiological testing. The Work is to be done in accordance with the Contract Documents and Specifications on file in the Development Services Department of the City of Hesperia, which are also available online via the PUBLIC|PURCHASE website, and as directed by the City Engineer. PUBLIC WORKS CONTRACTOR AND SUBCONTRACTOR REGISTRATION: Pursuant to California Labor Code Division 2, Part 7, Chapter 1, Article 2, a contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, or engage in the performance of any contract for public work with the City of Hesperia, as defined in said chapter, unless currently registered with the California Department of Industrial Relations and qualified to perform public work pursuant to Labor Code 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code 1771.1(a)]. It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by 7029.1 of the Business and Professions Code or by 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work at the time the contract is awarded. All Contractors and Subcontractors performing work on this project shall be required to furnish electronic certified payroll records directly to the Labor Commissioner (i.e., California Department of Industrial Relations - Division of Labor Standards Enforcement). The awarded Contractor shall post jobsite notices as prescribed by regulations. All Bidders and their subcontractors (that are listed on - List of Proposed Subcontractors or Sub-Tier Contractors) shall provide an extract from the Public Works Contractor Registration web site with their submitted bid providing evidence of active registration with the Labor Commissioner. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. NOTICE IS HEREBY GIVEN that under the provisions of California Labor Code, Division 2, Part 7, Chapter 1, Articles 1 and 2, the contractor and any subcontractor under the contractor is required to pay not less than the general prevailing rate of per diem wages to all workmen employed in the performance of work under this project for work of a similar character in the locality in which the public work is performed, including the general prevailing rate of per diem wages for holiday and overtime work. Pursuant to 1773 of the Labor Code, the Director of the California Department of Industrial Relations (DIR) has determined such general prevailing rates of per diem wages. The same are on file at the Development Services Department of the City of Hesperia, 9700 Seventh Avenue, Hesperia, California, and are available to any interested party upon request; or may be obtained online from the DIR website. The contractor shall cause a copy of said determinations to be posted at the job site. The contractor shall be subject to the penalty forfeiture provisions of the Labor Code for violations by the contractor or any subcontractor under him. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. Prevailing Wage Statement: This is a federally-funded construction contract funded in whole or in part with Highway Safety Improvement Program (HSIP) funds as administered by the U.S. Housing and Urban Development (HUD) Department. Federal Labor Standards Provisions, including prevailing wage requirements of the Davis-Bacon and Related Acts, as supplemented by Department of Labor Regulations at 29 CFR part 5 will be enforced for all contractors. The Contractor is responsible for ensuring subcontractor compliance with Davis-Bacon and Related Acts (DBRA) Requirements. A copy of the Federal Wage Decision applicable to this project is included in the Contract Documents and Specifications issued for this project. Addenda to modify the Federal minimum wage rates, if necessary, will be issued to all plan holders of record. The rate of wages for each craft or type of work or mechanic employed under this contract shall be as specified under the current determinations of the Department of Labor required under the Davis-Bacon Act. This project is a public work in the State of California, funded in whole or in part with public funds. In the event of a conflict between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates as determined by the State for similar classifications of labor the Contractor and its subcontractors shall pay not less than the higher wage rate. The Contractor's duty to pay State prevailing wages can be found under Labor Code*1770 et seq. Labor Code 1775 and 1777.7 outline the penalties for failure to pay prevailing wages and to employ apprentices, including forfeitures and debarment. The State Wage Decision is on file at the Development Services Department, and is also available online The City of Hesperia will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate, which most closely approximates the duties of the employees in question. Electronic certified payrolls are required to be submitted during the term of construction. Payment of contractor's invoice may be delayed when certified payrolls are not submitted in accordance with the California Labor Code. The City shall make progress payments on any properly completed payment request submitted by the Contractor. The payment request shall not be deemed properly completed unless certified payrolls have been properly completed and submitted on a weekly basis, for each week worked during the time period covered by said payment request. Apprenticeship Program: Attention is directed to 1777.5, 1777.6 and 1777.7 of the California Labor Code and Title 8, California Administrative code, Section 200 et seq. to ensure compliance and complete understanding of the law regarding apprentices. In accordance with 1777.5 and 1777.6 of the Labor Code, as amended, and the regulations of the California Apprenticeship Council, properly indentured apprentices may be employed in the prosecution of the work. Attention is directed to 1777.5 and 1777.6 of the Labor Code concerning the employment of apprentices by the Contractor or any subcontractor under him/her. Working Hours: The Contractor and any subcontractor under him/her shall comply with and be governed by the laws pertaining to working hours as set forth in Division 2, Part 7, Chapter 1, Article 3 of the Labor Code, as amended. The Contractor shall forfeit, as a penalty to the City of Hesperia, $25.00 for each laborer, workman, or mechanic employed in the execution of the Contract, by him/her or any subcontractor under him/her, upon any of the work herein before mentioned, for each calendar day during which said laborer, workman, or mechanic is required or permitted to labor more than 8 hours in violation of said Labor Code. Contractor shall pay travel and subsistence pay pursuant to Labor Code*1773.8. Minority and Women Owned Business: Bidders will be required to document their status as a Minority Business Enterprise (MBE), a Women-owned Business Enterprise (WBE) or a non-MBE/WBE firm. Non-MBE/WBE bidders will be required to make a good faith effort to subcontract with MBE/WBE firms and/or demonstrate good faith efforts to include such MBE/WBE firms as part of the contract bid. The City hereby affirmatively ensures that all business enterprises will be afforded full opportunity to submit bids in response to this Notice and will not be discriminated against on the grounds of race, creed, color, or national origin in any consideration leading to the award of contract. The City of Hesperia affirms that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation. Section 3 Statement: This is a HUD Section 3 construction contract. First preference will be given to a bidder who provides a reasonable bid and is a qualified Section 3 Business Concern. Second preference will be given to a bidder who provides a reasonable bid and commits to achieving the Section 3 employment, training and subcontracting opportunity goals by submitting a written commitment (Economic Opportunity Plan). Conflict of Interest: In the procurement of supplies, equipment, construction, and services by sub-recipients, the conflict of interest provisions in 2 CFR 200 (previously under State L CA - 24 CFR 85.36, Non-Profit Organizations - 24 CFR 84.4), OMB Circular A-110 and 24 CFR 570.611, respectively, shall apply. No employee, officer or agent of the sub-recipient shall participate in selection, or in the award or administration of a contract supported by Federal funds if a conflict of interest, real or apparent, would be involved. BIDDERS MUST SUBMIT, along with their bid - cash, a cashier's check, a certified check, or a bidder's bond, payable to the City of Hesperia in an amount equal to at least ten percent (10%) of the bid, as a guarantee that the Bidder will enter into the contract if the same is awarded to the successful bidder, and in event of failure to enter into such contract said cash, cashier's check, certified check, or bond shall become the property of the City of Hesperia. If the City of Hesperia awards the contract to the next lowest Bidder, the amount of the lowest Bidder's security shall be applied to the difference between the low bid and the second lowest bid, and the surplus, if any, shall be returned to the lowest Bidder. The successful Bidder shall be required to post a Performance Bond in the amount of one hundred percent (100%) of the contract price and a Payment Bond (Labor and Materials Bond) equal to one hundred percent (100%) of the contract price. Sureties shall meet all of the State of California bonding requirements in accordance with the Code of Civil Procedure ( 995.120) and be admitted by the State of California. Except as required by California Public Contract Code 20103.5 - Federal Funded Projects, no bid will be considered from a contractor who is not licensed at the time of bid opening as a Class A: General Engineering Contractor or a C-8: Concrete Contractor Specialty License. The work is to be done in accordance with the contract documents and the plans and specifications on file in the Development Services Department of the City of Hesperia. The contractor may, upon request and at the sole expense of the contractor, substitute authorized securities in lieu of monies withheld (performance retention) by the City. The successful bidder will be required to enter into a contract satisfactory to the City of Hesperia. The City reserves the right to reject any or all bids or any part(s) thereof, to waive any irregularities or informalities in any bid or in the bid process, and to make a contract award in the best interest of the City Contract Documents and Specifications on file in the Development Services Department of the City of Hesperia, which are also available online.
